What are Georgia DUI laws?

Last night I was pulled over for "Failing to Maintain Proper Lane" at 2:30 in the am. The officer asked if I wore contacts then asked me to get out of my car. I ended up blowing a 0.053, but I'm only 20 and won't be 21 for 3 weeks. The legal limit for under 21 is 0.02. I was arrested and taken to the Forsyth County Jail. I never went into a cell. I was there for about 3 hours. They let me leave with my license and my keys. I drove home but I should I technically still have been drunk? Why did they not follow procedures? Is my license suspended? By time I go to court I will be 21. I am charged with DUI, underage consumption and Failure to maintain lane. Also, the cop was emailing on his laptop while driving me to the jail. Should I bring that up or not?
I had one drink. In 3 weeks a 0.053 will be ok. No, the cop was emailing on of his coworkers about his father and personal stuff. I read them.

    Sorry for your problems, but you knew when you were drinking that you weren’t old enough to legally drink. Doesn’t matter how old you will be when you go to court. What matters is the age you were when you broke the law.

    How old you will be in three weeks doesn’t matter. Being that you’re almost 21, you should’ve been old enough to know the law. You broke it. As for the cop, what he did was wrong too, but that doesn’t cancel out the fact that you broke the law. Even if you do bring it up, they’re not going to drop your case. And if you blew a .053 after one drink, it was either a pretty big drink, or you weigh something like 70 pounds. I blew a .02 after drinking five beers in a one hour period.

    One drink raises your alcohol level about .02 on average. If you were .053, that tells me you had the equivalent of almost three drinks in your system. Your body can process about one drink an hour. Therefore, if you were a .053, you would have definitely been under.02 after three hours and probably zero.

    Bringing up the officer on his laptop will not help your case. The court only has jurisdiction on the offense, not on the officer’s conduct. You could file a complaint. That may result in the officer being disciplined, but it will not help your case.

    You can lose your license up to one year.

    You need to get a lawyer. As the cop indicated if you can not afford one you can get one for free. Contact the public defenders office.

    The fact that he was "e-mailing" (more likely checking your record) will have no bearing on your case.

    Police cars use lap tops for communicating between cars and between dispatch offices–we use them for everything–reports are also done in the car. So bring what up in court?? You were caught driving drunk–you will get fined and maybe lose your license for a while–millions get caught in the United States every year–you are lucky you didn’t wreck and hurt yourself or other people. The judge has a book that tells him what he has to do to you–If you havent figured it out by now–you better go to court—with a lawyer– Sorry but this will cost you–its a lesson in life–I suggest you don’t do this again. Its a serious violation. The alternative could have been being plastered on the road–dead–or someone hit by you and they are dead–in which case your life would be worth nothing. Jail is not a nice for people who do that kind of crime–inmates tend to beat stupid people–EVERY chance they get. If it means anything to you–at all—do NOT ever go to jail. Good luck with all of this.
