Under 21 DUI. Help with suspension lengths! CA?

I am under 21 but convicted of the over 21 DUI law. I was convicted of a DUI under vehicle code 23152(a). The law says this will result in a 6 months license suspension. The law for under 21 DUI (vehicle code 23136)says your license will be suspended for 1 year. Can my license be suspended for 1 yea...





I am under 21 but convicted of the over 21 DUI law. I was convicted of a DUI under vehicle code 23152(a). The law says this will result in a 6 months license suspension. The law for under 21 DUI (vehicle code 23136)says your license will be suspended for 1 year. Can my license be suspended for 1 year because I was under 21 even though according to the vehicle code I was convicted of says 6 months? By the way, I received a letter from D.M.V saying my license can be reinstated in 6 months, I just don't know if that can be changed if they notice that I am under 21.

    You’re lucky that you didn’t get the CA state mandated 1 year suspension (CA State law mandates anyone under 21 who violates any alcohol related violations [whether they were driving or not] their license gets suspended for 1 yr.).

    If the judge missed it at the time of your hearing, and DMV missed it, then it would appear that you got away with it…However, if DMV catches this oversight, don’t be surprised if you receive a letter from them. There’s always slim chance that it could change (only if someone from DMV caught the error)…obviously you wouldn’t go out of your way to let them know (Slips like this happens).

    During the meantime, you got lucky! Don’t do it again!

    there’s an old saying. "you get what you deserve and you deserve what you get".

    just wait until your insurance bill comes in. sky rockets for the next 4 years.

    you knew drinking and driving is against the law and yet you drank and drove anyway… do you think you don’t deserve it? this state is much safer without you on the streets.

    You will be penalized under the code you were convicted under. I don’t understand how they processed it under over 21 unless you turned 21 in the period between being busted and adjudication. If they slipped and didn’t catch your age, then shut up and take the 6 months. You make a bunch of racket, they may take it for 5 years. Stop driving when you are over the limit. There are all sorts of breathalyzers available online that are inexpensive and highly accurate. If you are going to party, stay or have a sober driver available. You have no idea yet how dramatically this can effect your future employment prospects. The insurance is the least of your worries at your age.

    Any alcohol offense (including offenses not related to driving) by a person under 21 results in a 1 year license suspension. (Veh Code 13202.5.) BUT that order has to be made by the court. Apparently the court forgot to do so in your case, leaving you with the 6 month suspension the DMV can order. Lucky you.
