


Question on Michigan's Heidi's Law DUI 3rd offense?

My husband has 2 prior DUI convictions, one in June of 1995 and one in January of 2004. He recieved another in November of 2006. Is he facing a 2nd or 3rd DUI conviction ? The prior law states they can only go back 10 years to make it a felony. Under the new law it is a felony if it is a 3rd over any amount of time. Due to unusual circumstances he is just now going to court on the 2006 charge. I believe I'm right on them only being able to charge him with a second since this DUI occured prior to the change in January, 2007. Anyone know for sure ?? (And please, no comments on his past actions, he did finally realize what harm his recklessness could cause himself or someone else and has not had a drink in almost 3 years) Thanks !!

It sounds like you have not obtained an attorney. It also sounds like there is more to the story than you have shared…why has more than 3 years seemingly passed before this coming to trial?
Have discussions with the prosecution taking place for a plea bargain now that 3 years sobriety has occurred? RJ
I’m not sure about the laws in michigan, but it sound like if you get a lawyer you have a good chance of having it count as only the second one, and it might be like you said where it is only the second because of when the new law was enacted, it is very strange that it has taken so long for it to go to court, anyway I think he will beat it with the help of a lawyer, good luck
