Now I would like to say that I have never done this and i'm never planning on it, just wondering about something. When a driver under the influence of another substance, besides alcohol (lets say marijuana), gets pulled over and fails the sobriety test but passes the breath test and the officer has suspicion that the operator of the motor vehicle is under the influence of EX. Pot, Can that officer give you a blood or urine test, and if you fail how can it be proven the time frame under which you were intoxicated? Also works vice-versa What if you are completly sober, get pulled over for dui suspicion, pass the breath test, but officer is convinced you are intoxicated so he gives a urine test but you have marijuana in your system from a day or 2 before, is it still DUI?
DUI – Driving Under the Influence
Can be alcohol or any other intoxicant that influences your physical or mental abilities, ie, pot, pills, mushrooms, chemicals that are sniffed, snorted, chewed, injected or ingested. If you are under the influence, you are not "completely sober" you are DUI. If a lab test concludes you have something in your system, you will be charged.
Many states have passed the law that they can arrest you for suspicion,and have 24 hours to sustain you,if you are on probation,or warrants then they will keep you,and do not care about the pee test,they just think you are under the influence,and thats it! they will charge you,and you have to go to court. or bond out before court the next day. All you can do is hope the judge believes you,and lets you go! Its ridiculous,and suxz! but cops are sopposely be here to help and protect,so if your not under the influence of anything,then i dont c y they would think so.
A person may be arrested and convicted of DUI whether the substance of choice is alcohol or drugs as both impair the driver’s skills.
Under the law, if you get pulled over for suspicion of driving under the influence, whether its drug or alcohol, most state laws require you to submit to a chemical test to determine the alcohol and/or drug content of your blood or as the officer may see fit based on his suspicions. Your license may be taken before conviction when a driver fails or refuses to take a chemical test.
