Sounds like your brother will be charged, at minimum, with BOTH hit & run as well as the DUI. Hit & run can be a felony with combined aggravating circumstances. But here’s a thought…ask your brothers attorney….the one that’s rep’ing him for the DUI.

How did they charge him with a DUI if he left the scene?

Hit and run and a DUI at the same time, did he drag the undercover cop so that he can give him the DUI. Also I am not an expert but I think for a hit and run, there probably will be some jail time.

How would you feel if you were the cop?

In my opinion, your "brother-in-law" should do jail time. I think a fine is letting him off wayyyyyyyyy too easy.

Depends on the state laws, prior record, and the court. California is $1000 to $10,000 or one year in jail.

Your brother in law needs a good lawyer and some soap on a rope.
He’s going to jail. Especially if he has any prior convictions.
