    You have addressed two very different issues.

    DUI/DWI is a public safety issue, operating a motor vehicle while impaired on a public road is a danger to everyone. The laws are in place to protect the liberties of other who use those public facilities.

    Banning smoking on private property is a violation of that property owners liberties. If you don’t like to eat in a restaurant where others smoke you are free to find one where there is no smoking.

    It is a simple matter of public vs private property.

    No. I don’t want to be on the road with drunk drivers and I don’t want to be in a restaurant sitting next to someone who is smoking. I’m all for individual freedom, but when that freedom puts other people in danger, the law should step in.

    It’s "nanny state / big government" to have the severity of those DUI laws apply equally to bicyclists in virtually all blue states.

    Smoking laws definitely are. As for DUI laws, technically you haven’t harmed somebody or their property until you run into them so is it really a crime? Does having a drink or 2 with dinner really make you a criminal?

    No moron, those types of laws are for public safety. Without them drunken liberals like you would be driving in their welfare wagons and running over kids.

    Yes. Why does the government think it knows better than me what my tolerance is? .08 BAC is waaaay too low. That’s barely anything and I could still drive fine with that.

    We have restaurants that you can smoke in. They just have a door separating the smoking section of the restaurant from the non smoking. Not our problem if restaurants are too lazy to do this. Ziggy’s, can smoke there every time we go.

    I hate smoking and I hate drinking. I am happy about the laws.

    Yes.
    HUMANS would punish unsafe driving drunk or sober. There is no legitimate interest in a driver’s blood chemistry, just in the actual operation of the car.
    Why YOU fear being allowed to choose whether or not to allow smoking on YOUR property escapes me.
