


Is it a crime in itself to USE illegal drugs? Would you be charged with possession in this case?
I'm trying to determine what, if anything, a person could be charged with for having used an illegal drug. This is under the assumption that the person had no drugs on them, and was breaking no other laws (like DUI). As though they walked into the police department, said "I'm just taken ecstasy...
I'm trying to determine what, if anything, a person could be charged with for having used an illegal drug. This is under the assumption that the person had no drugs on them, and was breaking no other laws (like DUI). As though they walked into the police department, said "I'm just taken ecstasy/smoked marijuana/etc., what are you going to do about it?" Anyone?
If you are not crearing a disturbance or dui and you are not in possesion of anything, they wouldnt even be interested in you.
If you asked a cop to do something to you though, im sure he could think of something to you one way or another. Seems kind of silly to do so though
I assume that if you confessed to possession your confession could be held against you, just as a confession that you had robbed a bank would be. And it seems self-evident that a confession of usage would imply a confession of possession, inasmuch as one has to possess a drug in order to use it. However, if I recall correctly, the mere fact that you have a drug in your system is not sufficient for you to be charged.
