I had a 2nd dui 9 yrs after my first offense. When I went thru all my programs and completed probation for my 1st DUI , the law required my dui to stay on my driving record for 7 yrs. I know the new 10 yr law took in effect a couple of years ago. Was this law retro-active? I was under the impression...





I had a 2nd dui 9 yrs after my first offense. When I went thru all my programs and completed probation for my 1st DUI , the law required my dui to stay on my driving record for 7 yrs. I know the new 10 yr law took in effect a couple of years ago. Was this law retro-active? I was under the impression that the new law was in effect for any convicted dui's AFTER the law was passed. Please advise. Thanks.

    Most but not all laws are not retroactive, the state you are in would make a difference whether it is common law or not, the old one is probably off the record but would still be available to court personnel.

    This law passed around 2004. The DUI attorney community fought like hell to get it to apply only to new DUI convictions, however, the courts decided to allow it to be retro-active.

    There is legislation in the process that would turn that 10 year period into a lifetime priorability for DUI arrest.
