They are not necessarily strong enough with a death occurs and the driver is a repeat offender OR if an accident happens and the driver is driving on a suspended license! And, yes , I have seen fatal accidents.

i think they are out of step with other factors
i was punished far more harshly for a non accident low alcohol content DUI, than a driver who ran a stoplight and blew me out of a crosswalk at 40 mph, breaking several bones (in a different year)
and studies show that cell phone use in driving is as dangerous as low BAC DUI, but you dont see people up in arms over that
