About three years ago I got a DUI, went through the ARD program and got it off my record. However, just last night I was arrested for my second.
Since it was so recently I don't have all the details yet of what I'm going to be charged with. I wasn't pulled over; I accidentally turned my car off the road and into train tracks. Car got stuck, police had to be called, car towed, etc.
From what it sounded like my BAC is likely to be .16 or so.. which puts me in the highest range, unfortunately for me.
For my first offense I did get a lawyer but I'm not so sure if it would be a good idea for the second one (AKA I really really dont think I can afford it). Does anyone have any experience, anything they've actually gone through? It seems like all of the DUI law websites are full of misinformation; the penalties they list for your first offense, even under ARD, are a lot worse than what I got my first time.
So yeah. Any advice? If its mandatory that I really should find a lawyer, I guess thats what I have to do. And people that have gone through this before in PA.. what should I expect?
(Not to be a jerk, but yes, I realize drinking and driving is stupid and irresponsible. I didn't go into "I'm not going to do this again." because it isn't what my question is about, but yes, I do realize what a stupid mistake it was. I'd appreciate if everyone could stay on topic; it already happened and I'd like to move on and figure out how to deal with it.)

Here’s some advice, try not drinking and driving? And if that’s too hard for you, try not drinking.
1.) See an alcohol counselor and consider not drinking any more.
2.) Consider inpatient, or outpatient rehab.
3.) yeah, if you want to try to reduce your fines, service and fees at all, you are going to need a lawyer.
youll more than likely get your license suspended. which you SHOULD because its totally irresponsible to drink and drive. usually if you cant afford a lawyer one will be appointed to you through the court.
You should have learned at first dui.
Now you get a lawyer and another conviction.
{sarcasm on} But, hey too bad for the car. It was important, right? What about the other motorists driving around that time of the day. Phhffffft. They not a big deal. {sarcasm off}.
Stop drinking and driving, you next step is someone planning your funeral. Stop being an idiot and you wouldn’t have this problem.
I would see if you can do the diversion program again, and also find out if you are eligible for a Public Defender.
I would wait until you make your first court date, to see where you stand.Then go get your occupational and sign up for a assessment and classes.
I personally do not think a Attorney is going to do anything spectacular for you, these are things you can do yourself for free.
Do not fall for all the ambulance chasers letters from Attorneys who claim they can perform miracles either.

Do you realize you could kill someone? you could go to prison for the rest of your life? its just not worth the risk to yourself and others.
