Ok, if someone has a d.u.i. and they are a passenger in a car and the driver is intoxicated, could the passenger get a second Dui? I am asking because my friend has a DUI and has to attend classes and he said he was told this. I dont think it makes sense so was checking to see if anyone else knew ...

What does DUI stand for? DRIVING under the influence. What do you think? It’s not against the law to be intoxicated as a passenger. In some states you could get an open bottle fine, assuming you have an open bottle of liquor with you.
Ask yourself this… If the passanger was drunk and he had a sober driver who exceeded the posted speed limit and then got pulled over, would the passanger be charged for "Driving under the Influence?" If the passenger LET the drunk driver drive with no driver license, they CAN be charged with Allowing another to Drive with Invalid Driver License. The answer to your question is no.
The passenger cannot be charged with DUI (Driving Under the Influence).
