    DUI, DWI, OUI, Impaired driving…

    Whatever your country happens to call operating a vehicle while being under the influence of drugs or alcohol, the laws are pretty strict in Canada.

    Section 253 of the Canadian criminal code has two methods for considering impairment:

    A) Operating a vehicle, whether it is in motion or not, while the person’s ability to operate the vehicle is impaired by alcohol or a drug;

    or

    B) Operating a vehicle having consumed alcohol in such a quantity that the concentration in the person’s blood exceeds eighty milligrams of alcohol in one hundred millilitres of blood.

    Ontario has the option to treat an arrest for DUI as either an indictment (like a US felony), or as a summary conviction (like a US misdemeanor).

    The USUAL penalty for a first DUI offence in Ontario is a fine, and suspension of your rights to drive in Ontario. You will also become inadmissible to Canada for a set period of time, if you are not a Canadian citizen or permanent resident.

    On a second offence, more often than not you are looking at jail time.

    You can count? Count your drinks and stop … You don’t state your age, but if you are young, think about this:

    Novice drivers of all ages in the Graduated Licensing System must maintain a zero BAC while driving. If you are a novice driver and are caught with any amount of alcohol in your blood, you will receive an immediate 24-hour roadside driver licence suspension, and will face a fine of $60-$500 and will receive a suspension period as per the Novice Driver Escalating Sanction scheme, including cancellation of the novice licence. You will also have to return to the start of your drivers ed.

    Drivers with a blood alcohol concentration of 0.08, or who fail to comply with breath testing, face an immediate seven-day vehicle impoundment at roadside.

    We don’t even talk about the other consequences; You will got to court, pay a fine and have your driver’s licence suspended for a period of time. Then you have to go back and get a driver’s education and test again before your are allowed back on the road.

    Your car insurance will probably go up drastically, perhaps as high as to $ 10,000 per annum for the first three years afterwards.

    As for drugs, the police will have a drug testing van parked nearby. All suspected drug users will be taken there for a blood test. After that: Read about alcohol above.

    SteveN, the Ciminal Code is federal, therefore, it is applicable in all provinces, not just Ontario.

    You can be convicted either summarily or by way of indictment in any province, not just Ontario!
