The Ca DMV came out with a new law stating that repeat DUI offenders can receive a restricted license with 90 days of their sentence served with a few other stipulations. I was convicted of my second DUI a few months before this date. I called the DMV and they said the law is non retroactive and I can not take advantage of this new law. Is there a way to go to court and see if they could change my conviction date or something so I can have this new law benefit me? You can view the stipulations of this new law on the Ca DMV website. The Vehicle code violations is 13352, it is division 6, chapter 2, Article 3 of the California Vehicle code. Thanks for any help Im really in a jam with out a license to work.

No. The DMV is correct. Your case is over. The law took effect as of 7/1/10. It has no effect prior to that date!
