    I have a prior DUI from 2001 in L.A. county. I am on summary probation from a misdemeanor in L.A. county that occured last year. I just got arrested in Orange county for a DUI in May. Are the D.A.’s in orange county going to know about my summary probation, and will L.A. county violate my summary/informal probation. Orange county cited me out. I took a blood test after 3 breath test. They never gave me the results of the breath test. They did give me the result of the blood…….which was a .27, so yeah I did deserve it. Even though I passed the field sobriety tests.

    Speak with your Public Defender about what to expect. Unless there are exceptional circumstances, you will probably get probation before judgment and not get jail time.

    What was your BAC? The higher the BAC the more problems you may have although I have seen a person with a BAC of .19 receive probation before judgment.

    Were you involved in an accident or simply pulled over or stopped at a sobriety check point?

    If you were in an accident were there any injuries? Causing injuries to others or damage to property will work against you?

    Were you cooperative and polite when you were pulled over, when the police officer was administering the field sobriety tests, when you were arrested and booked? If not all of this will work against you.

    Generally, the PD will be able to workout a plea agreement where you will plead guilty to one or more charges in exchange for a reduced sentence. Before you agree to plead guilty make sure you understand all of the charges you are facing (Failure to remain right of center, DUI, DWI, etc.) and make sure you understand what charge(s) you are pleading guilty to and what will happen to the remaining charges. Will they be dropped or placed on the stet (inactive) docket where they can be re-opened for any reason for a specific period and then only for good cause for a certain period after that. Find out if the prosecutor is willing to recommend probation before judgment or if they are merely willing not to object to such a sentence. Obviously, recommending pbj is better tha not opposing it; however, the judge is not a part of the plea agreement unless he agrees to bind himself to a certain punishment which, most judges do not like to do.

    If you do get probation, make sure you obey all of the rules or you could wind up in jail.

    Very important – if you do not understand something that is being said in the courtroom ask your attorney or ask the judge to explain it to you. There is no such thing as a dumb question. Generally once the judge rules and bangs the gavel it is too late to ask any questions or say that you did not understand something. You are going to be very nervous and want the trial to be over with as soon as possible but you need to understand everything before you plead guilty.

    Most important, do not drink and drive again, even “just a couple”. You could kill yourself or others and a second DUI/DWI would most liely result in jail time. If you go out drinking, designate a driver, take a cab or spend the night.

    .20 + is an enhancement which requires 48 hours jail time, community service, and a 9 month alcohol program. Whether you actual go to jail for those additional 48 hours depends what court you’re out of and what judge you’re before.

    Generally, when I get cases such as these, I try to get credit for time serve, try to get you out of the community service, and reduce the amount of alcohol school you’re looking at. Generally, it’s a “damage control” situation unless you can run a motion to dismiss.

    DMV, well, DMV can be won with paperwork technicalities, so you never know if your DMV case can be won just on BAC levels.
