    Hi,

    You’re still eligible for a job, as Law Enforcment in the State of New Jersey. According to the New Jersey State Police, you need to have been under a DUI twice. Caught with drugs, within three year period is automatic disqualification as well. However, if you ever sold drugs at anytime in your life is possible disqualification.

    Don’t get to excited though. There is almost no place in New Jersey with open Patrol Officer positions.. I don’t think there will be anytime soon.

    Your refusal in NJ will certainly affect your driving in NJ, even with a CT drivers license. More than likely what they will suspend will be your privilege to drive on the roadways and bi-ways of NJ. You were vague in how you put forth your information, and beyond that, I can’t help you. You stated that there were issues with the stop, but you never said what issues. That’s important info.

    as far as your green card, I presume you would be allowed to return, as you have an expectation of residency and citizenship,. and your citizenship hasn’t been disolved.

    DUI and Refusal to breath test in NJ. Effect of refusal conviction on out of state license?
    I received DUI and Refusal (2 tickets) in last week of October 2006. Since then there were total of 4 court visits in regards with this case. Looking at case matters, I did not refuse to blow but the new Alco test equipment did not record any BAC when I blew into the machine. There were many issues with the refusal and legitimate stop by the cop. There was no traffic violation / probable cause for my stop and the refusal could not have been proven beyond the reasonable doubt by prosecutor. So after discussing all the matters with prosecutor, he suggested a conference with Judge in my last visit to court. In the conference, after looking at issues Judge advised that because of involved issues in case, he will dismiss the DUI charges if I plea guilty for the refusal.
    Now at that time I had New Jersey driver’s license so my lawyer asked for some time to review the case and other details and went for adjunment which would also give me time to get Connecticut driver’s license as I live in CT (I moved to CT (5 months ago) before I got DUI but kept my NJ driver’s license). My DUI case is running but my driving rights are not suspended yet.
    The very next day I went to local DMV in Connecticut and got Connecticut driver’s license in January (2 & ½ months after getting DUI). They checked all my records and it came clear.
    Now in my next visit to court I have 2 options….I take the plea bargain offered by the Judge or I go for a trial…is it a good bargain (DUI dismissal and plea on refusal) ?
    Will my refusal in NJ affect on my CT driver’s license?
    Are refusal to submit breath test recorded on driving record?
    I am a permanent resident (green card holder). Can I go out of country and re-enter during the license suspension period?

    The following issues were involved in my DUI case and because of that Judge offered me plea bargain:-

    1.There was no traffic violation or cause for my stop in first place. I did not violate any traffic rule. The cop randomly stopped me without violation.
    2.Did 3 out of 4 Field Sobriety tests correctly. I was never instructed properly how to do these tests at all.
    3.The cop did not read the statement that they are supposed to read before breath test.
    4.He wrote (totally false) that I kept burping at the station which would void the breath test results. He did not wait at least 20 minutes before he tell me to submit the breath test.
    5.I made 3 attempts to give breath test but the alco test did not record BAC. My last 2 attempts had sufficient amount of air but still he gave me refusal.

    Kindly let me know if anything is unclear…. Would be glad to write it in different words. Sorry for my language. English is not my native language.

    I got the DUI 5 years ago and I’ve learned from my mistakes. In NJ it is not a criminal charge and it was only put on my driving record. Other than that, I was arrested for a small bag of marijuana which is supposed to be off my record.

    I’ve made my mistakes like everyone else, the only difference is I got caught by police. I’ve learned from it though. I’ve always had a passion for Law Enforcement and to keep everyone safe. I have a good set of morals that give me a passion to fight crime. I realize how irresponsible I was when I made those mistakes just a week after my 18th birthday. So now I would like to fight crime. I have great knowledge and would like to work in some branch of Law Enforcement.

    FBI, Sheriff’s office, Local police, whatever.. I don’t need to be a patrolman but I’d like to work in Law Enforcement.

    I’m trying to decide if I should major in criminal justice in college or if it’d be a waste of time. So is there any job I’d be able to get? I’ve thought of maybe just becoming a lawyer but I don’t know…

    What do you all think/know about this? Please tell me where your knowledge or opinion comes from.

    I live in New Jersey and was arrested in Minnesota on the DUI changes. For my court date I flew to Minnesota and finished up with my court , paid fines, etc. My lawyer said no more criminal charges. But, what are the effects of this DUI on my NJ lic? I mean I know that insurance will go up. But, will NJ DMV suspend my lic and charge me the state fee too (3000 over 3 years)

    The lawyer your boyfriend had sounds like a real sleazebag! It might take some time for the conviction to catch up with your boyfriend in NJ, but he can rest assured that it will.

    Did your boyfriend surrender his PA license when he got the NJ one? Did he report to NJ that he had a license in another state? Did he report that there was a case pending against him in PA to the NJ authorities?

    If the answer to all of the above is “yes” then his license will be suspended in NJ after the PA offenses catch up to him … but no new offenses will surface.

    Answer is “no” to any of the above? Knowingly submitting inaccurate information for filing is a crime all to itself. That could come back to haunt him in the future. Attempting to possess licenses in more than one state is also against the law. Depending on how he filled out the application in NJ he could have some serious problems heading his way!

    In NJ DUI is a traffic violation and not a criminal charge. So, it is only a violation on my driving record.

    It happened 5 years ago and now I’m a student in college 23 years old. I was arrested one other time for possession of a real small amount of marijuana. I was young and irresponsible. I made mistakes just like everyone, but I got caught.

    I’ve always had a passion for Law Enforcement, doing what is right, and bringing safety to the community. All my life I acted like a bit of a policeman and have great morals. I’ve learned that I was wrong and have considered a career in Law Enforcement since that is where my passion is. If all else fails I assume I could consider a career as a lawyer.

    Do I have any chance getting a job as a patrolman?
    FBI? Any other career in Law Enforcement? Any suggestions?

    I’m trying to decide what major to take in college and I don’t want to waste time majoring in criminal justice if I’ve already lost any chances.

    My bf was convicted of DUI in PA and lost his DL but already has a NJ DL. Will he be able to drive in NJ?
    Recently my bf was convicted of DUI in PA (2nd offense since 1988) but his lawyer told him that before his conviction that he should go and get a NJ DL so that he could drive in that state if he moved there. I’ve heard conflicting stories about this and don’t really believe that his lawyer knows what he is talking about. Mostly I’ve read that if your DL is suspended IT’S SUSPENDED no matter where you go. My bf is currently serving a mandatory 90 days in jail and wants me to inquire about getting car insurance in NJ before they (NJ) finds out about his sentence so we can move there and he’ll be able to go to work. PLEASE if anyone knows anything about this I would greatly appreciate your response. I’m not interested in hiring another lawyer since I’ve spent so much money, time, and effort on one that I don’t even trust. Thanks in advance for everyone’s help!

    You may have some difficulty with certain federal law Enforcement positions, but in NJ, a DUI is a Traffic Violation. It does not go on your criminal record, only your driving record. Something that happened years back (hopefully you have changed) won’t necessarily disqualify you from Law Enforcement jobs outside of NJ. I did hundreds of applicant background checks, and there were several who had old NJ DUIs whom I marked “recommended” when I sent their file up. But, the totality of the circumstances must be considered. If you have an old NJ DUI, and are still a shit bag, you won’t get hired anywhere.
