There is no doubt that MN DWI penalties can be quite severe, but one of the MN DWI penalties that can be the most concerning is administrative vehicle forfeiture. After all, no one wants to be without a vehicle, and you certainly don't want to get stuck paying storage fees for a vehicle that has been impounded.
According to Minnesota DWI law, your vehicle may be seized after you get your third DWI violation within a ten-year period. You may also have your vehicle taken if this is your first or second offense, and one or more of the following factors are also involved:
- Having a prior impaired driving incident within 10 years prior to the new offense
- You had an alcohol concentration of 0.20 or more
- A child below the age of 16 was a passenger in the vehicle
- A child who is more than 36 months younger than the offender was also in the vehicle
This penalty for a Minnesota DWImay be enforced by the arresting officer, though the prosecuting attorney must also serve notice to the owner or owners of the vehicle. Unless the owner of the vehicle appeals the forfeiture by filing for a judicial determination of forfeiture, the penalty for a Minnesota DWI will be administratively enforced after 30 days.
In order to be subject to forfeiture under Minnesota law, one of these conditions must be met:
- The vehicle was used to carry out the offense and the person driving the vehicle was either convicted of the offense or failed to appear for trial.
- The vehicle was used to carry out an offense that resulted in the designated license being revoked, and the driver either failed to seek administrative or judicial review in a timely manner or the revocation was sustained after being reviewed.
If you own other vehicles besides the one that was involved in the incident, those vehicles are not subject to forfeiture. Further, if you are driving a vehicle that belongs to someone else, the law dictates that this vehicle is also not subject to forfeiture if the owner didn't know, and didn't have any reason to know, that the vehicle was going to be used in an unlawful manner.
The bottom line is that vehicle forfeiture is one of the harshest MN DWI penalties that you may face. Not only can it leave you without transportation, it can also cost a significant amount of money in the long run - particularly if your vehicle is permanently retained. Therefore, it is important to contact an attorney as soon as possible following your arrest. This way, you can have the best chance of minimizing your MN DWI penalties and will be at less risk of losing your vehicle.

My son was with a girl he was dating and her sister,and had been drinking,when they left the bar the girl he waas dating wanted to go to her exs to get her divorce papers to show my son. She was pulled over and given a dwi. My son now recieved a court date for aiding and abitting as the girl said they made her drive. Has anyone ever heard of this type of conviction as everyone we have talked to has never heard of this.So if this is possible,should all bartenders be aiding if someone gets a dwi Thanks

Fight it in court when you. and tell your son to dump that chick since she is obviously not an honest person for doing that. she just didnt want to take the fall all by herself.

DWI arrest in Mn.( this doesnt seem right)?
My friend got pulled over while driving his motorcycle and was asked to do a sobriety test, He did all required and was brought to jail. Befor he was hauled in he asked what he blew on the test and the officer wouldnt tell him. The officer even took his time (about 2 hours) of driving around prior to bringing him in and still refused to tell him what he blew. When he arrived he was asked to blow again. At this time he says, he was upset with the arresting-officer who wouldnt give him the info. So he told the booking police he already did all the tests including the walking straight line etc…And that they should/could get the results from the officer who brought him . So he refused to blow again until he knew what he blew on the first one. He had no reason to believe he was over the limit, and would have gladly taken a second test, but he just thought it was his right to know exactly what and why he was going to jail for and just wanted the proof, isnt that what usually happens when your being arrested? The cop tells you what u blew and why your being haulded in? We never heard of anyone going to jail after doing all the road test, unless they failed on site, or refused to participate?!..but he was pulled over as told because “his arm looked lazy” WTF? He knew he passed the tests, he just wanted the officer prove it . So he gets charged for DWI anyways because he refused to take the 2nd test until he was showed the results of the 1st. Is that legal? Did he have any rights here? What can be done?
You two have a point! I`ve never had a dwi, but we thought once given, a person had a right to know, he thought he was being harrassed by the 1st guy. Thank you for the advise guys !
In most states, if you refuse a breathalyzer test (even if the officer messed up the first one) when you are at booking… you will be charged with the offense you were brought in on.
Your friend is an idiot and you should slap him for being one. Because the cop took two hours to bring him into booking, that is two hours that any alcohol can be metabolized by your system and be less than you would have blown previously. Had he done the breathalyzer when asked again, instead of arguing about it… they would have sent him home, or given him a significantly less ticket.
