DWI 4th Degree first time, st.paul MN?
Hi, I am really nervous since I got my first DWI, it is 4th degree and it is my first time. I know I’ll be calling a lawyer in the morning but until than can anyone tell me how bad this is. I have not bee n able to concentrate on anything all day and am very worried. Also, I am not drinking again. I had one martini and that was it.
the blood alcohol level was 0.11. no other charges.
Question about DUI/DWI.?
So a friend of my just got a DUI. After he told me the story I couldn’t stop laughing but it made me think.
He and another friend were at a party. My friend is 19 and his friend that was driving was 22. Long story short, they pull into a gas station so the 22yo can grab some smokes. While he’s in there, he leaves the car running and my friend in the passanger seat who is sleeping. A cop pulls into the gas station, wakes my friend up and gives him a breathalyzer. He blows a .12 and the cop give’s him a DUI.
The actual driver of the car comes back out, blows a .03 and doesn’t receive any ticket or citation.
Several questions:
1. How in the world can this be a reasonable search and seizure, he wasn’t making a scene or causing problems, for godsakes he was sleeping. Not sure why the cops even decided to bother him.
2. Since the security camera tapes will show he never got out of the car and that the 22yo was driving, how in the world can they give him a DUI?
This is in MN if it makes a difference. He’s going to talk to a lawyer today. Any questions comments concerns. Thanks!
The thing I’m reading also is that in MN the courts have to show that the person had the intent to drive. Since that’s clearly missing in this case I’m thinking he has a shot of getting out of this.
I know we’re splitting hairs here but it’s not illegal to leave the car running as long as a licensed driver is in the vehicle.
He had to go to work but hopefully sometime tonight I’ll get the info on what the lawyer said. I’m finding this fascinating (probably more so since its not me hahahahahah).
im the fool who got his 3rd dui, please advise?
i got my 3rd dui in minn how bad off am i. there is no excuse and im very ashamed and embarrassed. my other two where within 2 weeks of each other when i was 20 and im 26 now. i really dont have a drinking problem i just put my self in a stupid situation to where my decision making skills where impaired. i just bought a house that im workn my rear of to pay for while i am remolding it . this is almost the worst thing that could happen to me at the worst time. im not the jail type, how long am i going to have to serve? is house arrest a alt? if so what if my house sits on 8 acers? not to mention the whole license situation. here in mn 1yr min loss with 2nd deg dwi(3rd). my lawyer said i might be able to do interlock for work permit but have to wait 30 days. im self employed and plow snow in the winter with my truck and skidsteer, how do i get a work permit for that? this is horrible and i feel awfall for putting my girlfriend and family through this. tell me somthing ?

maybe you’re not an ‘alcoholic’ that must forever remain absitenent and go to AA, but you most certainly DO have a drinking problem, no iffs ands or butts – a drinking prblem is simply described as drinking that causes a problem. by you’re logic, having your third dui is not a problem, so why sweat over it? as long as you think this isnt a problem, it’s never going away

maybe not in you’re opinion, but you are in the eyes of the ‘sentencing types’ (aka judges). and they decide who the ‘jail types; are
lose the ‘i dont have a problem attitude’. you can sell that on a 1st, streeeeeetch to sell it just possibly on a 2nd, but on a 3rd, that’s never going to fly with anyone, anywhere – they’re just going to slam you harder to wake you up

I am not familiar with MN law, but it sounds like there was no probable cause developed, and the vehicle was not on a roadway, but stationary on private property at the time.
MN law may have some strange thing in it that say if the car is running, then any potential operator can be found in violation of the law.
A lawyer is a really good idea for this one.
