At the age of 17 I got a dui. It was a stupid mistake and I regret it to the fullest. Now I’m 20 with an associates degree from a tech. Trade school for automotive diagnosis and repair. Assuming that all the facts are accurate, you were NOT convicted of a DUI. In fact, you were not convicted of any crime. A Preliminary Alcohol Screening device (a “PAS”) showed that you were driving at a .01 while under 21. That can be a violation of Vehicle Code section 23136. That is not DUI, which is VC section 23152. However, if the PAS registered .01, it is unlikely that you would be charged, since there is a margin of error in any testing device, and it is very difficult to prove the charge beyond a reasonable doubt when the test itself is doubtful at that point.
However, the DMV does not need a conviction to suspend your license. When they get a report of the PAS result of .01, they suspend your license under VC 13353.2. The possible error in the test does not matter with DMV, because it is the test result alone which causes the suspension.
So, if you are asked whether you were CONVICTED of any offense, the answer is “no.” If you did not go to court, then there was not any conviction, and none will be shown in any record. The determination under VC 13353.2 is statutorily defined as a CIVIL matter. If, however, you are asked whether your license was ever suspended, the answer is “yes,” but NOT for DUI–it was for driving at .01 when under 21–a far less serious offense.
If you are not asked, it is unlikely that this suspension will appear in any record.

When I was 18 years old I blew a .01 the morning after a night of drinking, in santa barbara county. Now i live in contra costa county. Both in California. the only punishment i got was drivers liscence suspension for 1 year. Thats it. no fines. No court. Just that.
It has been 7 years and I am applying for a pharmaceutical job that gives me a company car and pays all my insurance and everything. I have called 4 insurance companies to get quotes and to run my record and there is no trace of the DUI. They only check the last 5 years.My question: When I goto apply for these jobs and they do a background driving check are they going to find my dui after it has been over 7 years?
I stated no on the applications, but dont want to waste my time interviewing if it comes up>HELP i need an accurate answer!
