Driver Faces Felony Charges After Fatal Yuba City, California Drunk Driving Accident

A Yuba City, California driver can expect to be charged in connection with a drunk driving accident in which two of his close friends were killed.

The accident that occurred on Highway 99 near Live Oak, California on November 16th, is just one more reminder of the needless risks we take with the lives of those closest to us when we drink and drive. The driver in this car crash, 20-year-old Abdul Umar Hay, was returning from an all-night party with his friend Rafael Courtland Walker and Matthew Stephen Fair. Initial reports say that Hay must have dozed off at the wheel, causing the car to zip though a stop sign. A short while later, it was broadsided by a Ford Explorer.     What class is a drunk driving felony? And what kind of effect does that have on international travel?

    I’m asking if a drunk driving felony can prohibit entry into foreign countries. I know Canada does not allow a person with a drunk driving on their record to enter the country. I do not know the laws or how to research the laws for other countries.

    Should drunk driving be a felony on first the offense?
    Here’s what I’m bothered by. In my state:

    first offense = fine
    second offense = time or jail
    third offense = possible loss of license which they get back after going to a class.

    And so on. One guy was in the paper on his 14th!

    And think about this. For every time they catch a drunk driver, there’s got to be like 9 or 10 times he/she did it and wasn’t caught. So that’s like 30 trips behind the wheel before my state takes the license.

    Well, not all drunk driving (DWIs) are felonies. In fact most are misdemeanors. Canada routinely won’t let people with a DWI conviction into their country, even misdemeanors. They make it very clear on the web, as does the US state department. It is best to contact the state department for any international travel, as EVERY country has different requirements or restrictions.

    Also, state law and circumstances dictate what class of a felony a DWI is when it is a felony. I recent caught a woman on her third DWI in 6 months, she was charged as a persistent offender and was convicted of a class D felony (lowest class in Missouri).

    However, recently in my county, a man was convicted of his 19th DWI in a few years, was convicted of a Class A felony (highest class) and sentenced to 20 years in prison.

    my dad wants to be a truck driver again, but he only has a CDL B, and he got fired awhile ago because he got caught drunk driving… that’s the story he told me, but I think there is more to it, but does the drunk driving thing count as a felony or a misdemeanor????

    well will the DUI ever be taken off? Or will it stay on even longer, because that happened when I was, like, 6 or 7, and I’m 15 now, but its still there…

    After 15 years he can petition for his criminal record to be sealed if this is the only thing on it. Usually costs about $500- depends on the state you’re in. Because his insurance liability is so much higher now, I doubt any truck driving company will hire him becasue he will raise the overall company premiums and may not even be eligible for coverage at all. As far as felony or misdemeanor DUI it depends on what he was convicted of- aggravated DUI is a felony and is called aggravated when a person blows over twice the legal limit= or if reckless driving also occurred during the time of the charge. If he was convicted of a DWAI this is a misdemeanor and is usually what people with DUI charges plead to during a plea bargain.

    Murdering someone’s kid or dad or mom while you drive drunk as long as you had fun isn’t all that bad. Right?
    Aren’t sentences way too stiff? Dems tell us Ted rehabilitated and had no need to go to jail for the murder of Mary Jo.
