probably not to be real honest with you. most first time dui offenders get the same outcome for that state. it may change with state to state but it usually the same for everybody. rich or not rich in this case. so its not “going away”. you might have to take some alcohol courses, your license probably(will)will be suspended and you pay some huge fines. i dont think you need a lawyer for this. i would say plead not guilty then after that you should go talk to the prosecutor, maybe he may make an offer of somekind. who knows?

i was pulled over for dwi…first offense (.11 BAC) i have the name of a lawyer who is supposed to be the best but he’s 5,500 plus fees for expert witness etc. another lawyer, who i don’t have any info on, is 2,500. i’m unemployed..i need the charge to go away but is spending more on the lawyer more of a guarantee of a better outcome?

Anyone got a DWI ticket in the state of NJ. If so, what was your punishment? (ie how many months of license loss, court fees, etc.). This is my forst offense and I already got a lawyer, but I’m juist trying to see what I should het ready for.
Speedy Trial for DWI in NJ?
I got a DWI when I was 17 in NJ (2/9/07), I had never received anything saying that I needed to appear in court. My lawyer contacted me Friday saying I needed to appear in court this Thursday. Can I fight this with the Right to a Speedy Trial? It has been over 2 years. I lived with my parents back then and was able to get rides to places to work, school, etc. Now my parents live an hour away, I can’t get to work and come September I won’t be able to get to school. Can I fight this?
NY DWI, NJ License Surcharges in Both States?

I’m sure a lor of people might want to just tear me apart for getting the DWI in the first place. I assure you I was younger and much more foolish then than I am now. So my situation seems to have escalated a year after sentencing. I was asked to pay 1000 dollars over the course of a year for NJ and 250 dollars per year for three years to the state of NY where the misdemeanor ruling was given.
Today one year after starting to pay the thousand dollar surcharge to NJ they added another thousand dollars to my balance. My questions are as follows:
1. Am I supposed to be paying these surcharges in both states? (NJ is supposed to be based on points and they have not added any points to my record.Also, the crime wasn’t committed here so why am I being charged here, there was no hearing or anything in NJ)
2. Is it worth spending my time and effort trying to get these surcharges dropped? ( My case was ruled as a conditional discharge which according to my lawyer meant a clean record in a year.)
Any help is greatly appreciated.
I have paid my dues, so please only helpful answers.

John E, thank you for your insightful comment really. No offense intended but i didn’t kill or hurt anyone, but i have realized my errors and have not once done it again.
OK, you made a mistake and got a DWI at the scene of an accident. Not a great thing to do, but not the end of the world.
It sounds like you have already done the intelligent thing and hired a lawyer, good for you! They are your representative in court for this charge. Your lawyer has appeared in this exact court, before this same judge many times before. Your lawyer has a good working knowledge of this court’s procedures … ask your lawyer if the trial can be postponed! They will have real knowledge of the judge’s attitude towards postponements for the convenience of the defendant. Some judges will allow a postponement, some will not.
The other option is to find out if you can actually move the trial date UP, so that this is settled before you go on vacation … that way it will not be hanging over your head during your vacation.
Car crash, no injuries … you do not mention hit and run. The only real problem is the DWI aspect of this situation! The fines will not be a pretty sight, your license will probably be suspended for a while, and you will probably get some community service as part of your sentence. Probably not what you wanted to do when you came back from vacation, but it could be a whole lot worse!

Appreciate your response comment : Good job not killing / hurting anyone. You have a lawyer, tell them to make the extra fees go away or give a reason why not. Legal malpractice exists also. Sounds like you are an honest dude, and you paid your lawyer already.
Is there any way to push the court date back if someone is facing a DWI charge?
I recently had a car accident (no one was injured, thank GOD!) I made a terrible choice after an end-of-year school celebration. I know this was a terrible choice because I am falling apart emotionally. Please, don’t grill me about it. I need to know if there is any way to postpone a court date for someone facing a DWI charge (first one). I’m preparing myself to live with the consequences… I planned to spend three weeks abroad on vacation. I’ve never been abroad before, never really been anywhere. I had been planning this for months, and now this mess. The court date falls a few days after I am supposed to leave. If court dates can’t be postponed, do I have to be physically present in court, or can my lawyer represent me without my being there? I live in NJ. thanks. i could use a few prayers, too.
