If you've been charged with a DUI in WA, what will happen? Well, the first thing you should do if you've been charged is to contact a Washington State DUI attorney. DUI lawyers are well versed in the law regarding DUIs and they'll be able to tell you what your rights are, what sort of penalties you can expect, and help you retain your license. But, what is the legal process for a Washington State DUI arrest ?
The first thing that you should do to protect your right to drive is request a hearing with The Department of Licensing, your DUI attorney can help you with the filing of this request. You should be assured of at least 60 days of driving from the date of arrest
Next will the arraignment, the date of the arraignment may be on your ticket. It is mandatory that you appear in court for the arraignment and it is a MISTAKE to appear without a DUI lawyer there to protect your interests, advise you and explain the Washington DUI process.
During the arraignment, you will also be given the chance to state whether you are guilty or not guilty to your Washington State DUI charge. Your attorney will be able to advise you on the best plea to make, depending on your personal situation. Sometimes the stop was not made properly by the arresting officer, or proper procedures were not followed once you arrived at the station. There are many possible reasons why you might not have to simply show up in court and take your punishment, and a good DUI attorney will be able to help you make sense of them.
Your DUI lawyer will likely meet with the State Deputy Prosecuting Attorney in a pre-trial conference to review the evidence and possibly even negotiate a plea bargain. Following the hearing your attorney may file motions to suppress any evidence where your constitutional rights have been violated or proper process was not followed during your dui arrest.
There are many things that will happen in a Washington DUI. Hiring a good Washington State DUI lawyer will be your first step in protecting yourself and your rights during the Washington State DUI Process.
What are the penalties for DUI in Washington state?
My ex-husband got two DUI’s in January 2008. He skipped a summer court date and got warrants. He went to court and was given a new court date in mid-October. In early October, he was arrested again, possibly for a third DUI, I’m not sure, it may have been driving without a license. He skipped his mid-Oct. court date and got warrants again. Now he’s in jail and has court early next month. Any ideas what he’s gonna get?
Lillie, I will not help him because he’s my ex-husband. We were married seven years and he was emotionally and verbally abusive, a liar, cheater, drug addict, and alcoholic. While we were still married I did everything in my power to help him every possible way I knew how… but he’s on his own now.
LOL goGotro… yes, he’s white, no he’s not rich. He cleans up pretty well for court but he’s been in jail for two weeks now… do they let you shave in jail? I don’t know, never been there, nor do I need to shave… : )
longer jail time. where you married at the time? why are you not stopping him from drinking and driving or helping him with court dates?
i don’t know but I’m very interested in law in Washington state
Under Washington’s laws for a DUI, R.C.W. 46.61.503, you were arrested. You were let go within an hour?
What did you register for alcohol content? (DUI is a gross misdemeanor offense)
Find a lawyer who does DUI cases and consult with them also, if you were under 21 another code of the RCW applies.
How much is a DUI lawyer in washington state?
Just curious how much they usually tend to ask for as a retainer fee (initial money down). This would be for the North Seattle area. Not this person’s first DUI.
Is it possible to get rid of a DUI in Washington State?
If someone got a DUI in 2002, hasn’t been in trouble since, and completed all requirements for a deferred prosecution, is there a way to seal, destroy, vacate or expunge this from their record, to prevent any trouble in the future with pre-employment background checks?
The charge was dismissed with prejudice.
I’m looking through court information, but I don’t really understand this legalese. Any help is appreciated.
Good lawyers aren’t cheap and cheap lawyers aren’t good. for a second DUI, you can expect to pay between $2k and $7k. This will probably not include trial.
As for initial money down, it depends on the lawyer. Some will accept payments, and others don’t.
Will i have to go to jail for my first dui in Washington State?
I was taken to the station for about an hour and then let go, but will they put me in jail when i go to court? Will they do electronic monitoring instead and if so how does that work? Can you leave the house to go to work?
Passenger in a DUI, Washington State. Information on other state would be appreciated.?
Although this doesn’t matter in a legal sense, in any case I would not let someone I know who is drunk drive me. I would either be too drunk to realize or I would think my friend isn’t that drunk. What would happen if my friend got a DUI and I was a passenger in the car under the following circumstances:
A. I am drunk, very very drunk.
(I think that I get public intoxication)
B. I am buzzed.
(The probable scenario)
B. I am perfectly sober.
Thank you!
You would not be charged with anything unless you are in possession of an open bottle/container or alcohol or not behaving in a good manner.
