Are You Facing A PA DUI Second Defense?

Pennsylvania treats second time DUI offenders more harshly than first time offenders, particularly with respect to mandatory minimum jail sentences. You should be aware that the PA DUI penalties and the mandatory minimum jail sentences are significantly increased for a PA DUI second offense.

If you thought it was rough being arrested for a PA DUI the first time, the second offense will likely be far more severe.

The mandatory minimum jail sentence that may apply in a given situation for a PA DUI second offense within 10 years will largely depend upon the alcohol concentration found in a sample of the offender's breath or blood taken within two hours of driving.

Under Pennsylvania law, there are three tiers of BAC DUI offenses:

  • General Impairment: BAC a‰¥ 0.08% to <  0.10%
  • High Rate of Alcohol: BAC a‰¥ 0.10% to <  0.16%
  • Highest Rate of Alcohol: BAC a‰¥ 0.16%

For a second General Impairment offense, a DUI offender's penalties may include, among other things:

  • a minimum of 5 days in jail
  • a 0 to 00 fine
  • a 12 month license suspension

For a second High Rate of Alcohol offense, a DUI offender's penalties may include:

  • a minimum of 30 days in jail
  • a 0 to ,000 fine
  • a 18 month license suspension

For a second Highest Rate of Alcohol offense, a DUI offender's penalties may include:

  • a minimum of 90 days in jail
  • a 00 to ,000 fine
  • a 18 month license suspension

As you can see, the penalties for a PA DUI get progressively worse as the blood alcohol content rises. Unfortunately, a DUI suspect cannot avoid these penalties simply by refusing to provide a sample of breath or blood for testing. While that might seem like a logical and easy way out, it actually could become a bad decision.

You see, individuals charged with a PA DUI involving a refusal to provide a breath or blood sample for testing will automatically face the same penalties as an individual convicted of the Highest Rate of Alcohol offense, and may also face an additional license suspension. Still think refusing a breath or blood test sounds like a good idea?

    What are the Penalties for a Second Offense DUI?
    Here’s the deal: My idiot cousin just got a second DUI in Idaho. His first DUI was around March in Oregon, and he is still on probation. His first offense all he did was promise to take AA classes. And I’m just hoping this time around he might actually learn something… perhaps, hopefully, even serve jail time. I was wondering what are the penalties for a second offense?

    I know that DUI laws vary in each state, but if you know anything about Idaho DUI laws, that would be greatly appreciated.

    Thank God your cousin did not kill anyone; he was lucky this time but the next time he might not be…he might take someone’s life.

    DUI First Offense
    Up to $1,000.00 fine
    2 days to 6 months jail
    Suspend driver’s license for 180 days with at least the first 30 days absolute and the remainder restricted
    Obtain an alcohol evaluation
    Follow the recommendation of evaluation
    Attend Victims’ Panel
    1 to 2 years probation – may be supervised.

    DUI Second Offense (within a five year period)
    Up to $2,000.00 fine
    10 days to 1 year jail
    1 year absolute license suspension
    Obtain an alcohol evaluation
    Follow the recommendation of evaluation
    Interlock device on car for 1 year after driver’s license suspension ends
    2 year probation – usually supervised.

    What is the typical “Penalty” for a second offense DUI in Wisconsin?
    So my dad got arrested tonight for his second DUI. I think the last one was 3-4 years ago maybe? I was wondering what is going to happen as far as his drivers license and is it even possible for him to get jail time? I do not know what his blood alcohol level was.

    No. If you get a third one, your “sober house” might be a prison cell, but our court system cannot afford to pay for civilian housing.

    Deal with this problem now. It only gets worse as you get older. I know a guy who had, I think, three or four DUIs. Then he killed someone in a car accident and got 15 years in prison. His family is very rich, but they couldn’t bribe or buy his way out of his problem. He served every day. I suspect he celebrated his release with a bottle of scotch.

    Sometimes a court will “sentence” you to attend AA meeting and require someone there to sign your attendance sheet. But AA is anonymous, so the authorities have no way of knowingh who signed the sheet. You will probably get a fine, community service and a short or suspended jail sentence. Then it’s up to you.

    I’ve found lots of statistics for alcohol related crashes, but none identity second offense.

    The judge ordered me to wear the scram bracelet for 30 days after i had went to my arraignment. My sentencing court date is this weeks. Will he leave the scram bracelet on me or send me to jail?
