Senate Bill 1069 Will Increase the Minimum DUI Punishment

The latest news, according to a Phoenix
DUI attorney is that the Senate Bill 1069, which is about to be heard
by the Arizona State Legislature in the Second Regular Session of 2010, is coming
up with a proposal of changing the existing class 6 felony of DUI with a 15
year old person in the vehicle to a class 4 felony. According to the existing Phoenix
DUI law, if a person is driving a vehicle under the influence of alcohol
or other drugs with a 14 year old or younger child in the vehicle, it will be
charged as a DUI offense and they will be subject to the corresponding DUI jail
time agreeing to its misdemeanor counterpart.
As the
DUI lawyer said, the new Senate Bill
makes a proposition to change the designation of the offense from class 6
felony to a class 4 felony. The bill further proposes to increase the
punishment to match up to the standard of class 4 felony Aggravated DUI
punishment. This punishment, however, is imprisonment for at least 4 months for
a first offense. Imprisonment here refers to the person being condemned to the
Department of Corrections without being released for work (no work release or
work furlough option)

For the Alabama driver, convictions for a first DWI/DUI carry penalties of a fine ($600-$2,100), and/or one year in jail, and mandatory DUI school attendance. A first conviction also causes you to lose your license for 90 days.

As an addiction therapist, I actually have a list of these, that I show clients when they complain they have to attend classes. In Turkey, a person is driven out into the country and forced to walk back. In another country the man AND his wife are jailed. (that makes the wife terribly happy). In some So. American countries, you are shot on the spot. In Australia, your name and picture are put in the paper with the caption, “caught drunk driving.” There are more, but I don’t recall them all off the top of my head.

Driving a motor vehicle while “intoxicated” is as close to wreckless-endangerment of human life as “one-can-get” without actually hurting someone…till the accident… Oye !
…Ok… 1st. offense… no accident, no one hurt…just DUI 1st. time…? …$1,000.00 fine 40 hrs. community service, loss of drivers license 6 months. Driver education course as determined by the local standards…
2nd. offense…no accident, no one hurt…just DUI X2…?
30 days Jail…no time off… $2,000.00 fine Mandatory out patient re-hab when Jail time has been served. loss of drivers license for 1 year… after suspension of license. Given limited license… to and from work, church, AA meetings… must keep travel log with millage for Law Enforcement inspection at any time for the next year.
3rd. offense of DUI…no one hurt, no accident… $10,000.00 fine… 1 year in Jail… 10 years loss of license. (Period)
If any of the DUI’s have an accident or some one is hurt. the 3rd offense would apply to any case… such as Dui # 1 &2 shown above. If the DUI resulted in the death of someone.

Does anyone know the usual punishment for a first offense DUI in California? He was well over the legal limit, but not speeding or any other traffic offense, didn’t hit anyone or anything, didn’t refuse to do a breathalyser and admitted he had been drinking, and also he has never been arrested before. Its generally about a 4-6 month license suspension, 2 years probation (court probation if zero priors, formal probation with any criminal history), and between $1600-$2100 in fines, court costs and alcohol classes.
