An Overview of Dallas DUI Offense and Texas DUI Laws
Submitted by: Steven
Charged with DUI in Dallas, leaves you with no choice other than consulting a
qualified and experienced Dallas DUI attorney as early as
possible. Many people think that DUI offenses are as simple as any other
traffic offense. But the truth is this type of offense has much serious
consequences and legal issues that leave deep impact on the offender
DUI offense?
For a first time DUI offense (21 years old) with one prior misdemeanor, is it necessary to hire a lawyer? I hear yes from some people and no from others, so am unsure as to what to do. Any advice would be appreciated. Thanks.
This is in the state of California by the way
Yes, as soon as the Offender driver has entered the police station, he will be searched and his drivers license will be presented to the booking officer, who will write it all down, and it will be in the record.
The DUI itself is going to cost you a lot. The penalties for a first offense are pretty standard. I’d save my money and just deal with the courts on your own. If you are in a position of affording it though hire a really good lawyer that specializes in DUI offenses. The really good ones can get anyone out of anything. They will dispute the accuracy of the breathalizer by questioning the last time it was calibrated. The ground on which you took the impaired skills test (walking the line) did it have any pebbles or loose rocks on the ground. Did you burp at all before giving the breathalizer they are suppose to wait 15 minutes before giving the test. A really good lawyer will get you off so really it all depends on your economic situation
DUI OFFENSE…………………………..?
For a DUI charge, at the time the offender is arrested will the drivers offense be entered in the computer right away of what he has done??? If not, how long will it take?
Thanks
Is it advisable to retain legal counsel for DUI offense, or is a public defender adequate?
I have a friend that has recently been charged with a DUI and she does not know if she should get an attorney or merely appear in front of the judge with an explanation. Clean record, no prior offenses
She is nervous
As a first offense DUI, with an otherwise clean record, the most she will get hit with is a large fine. She can enter a guilty plea, the judge will ask if she has anything to say. This is where she has a chance to mitigate the fine. She needs to grovel a bit. She apologizes for her lapse in good judgment, point out that she has never done anything this bone head stupid before, that this experience has been embarrassing, frightening, expensive, and will NEVER be repeated again.
Public Defenders are not automatically appointed. You have to request one. You only get one if you are too poor to hire your own attorney. If she has a job, owns a car, etc., then she can hire her own lawyer. If it means going into debt, the court does not care. Only the destitute get Public Defenders.
What is a probation violation for a 1st offense DUI misdemeanor in California?
Is it a violation to be in a car with a driver that is intoxicated(your the passenger) when you had a 1st offense DUI misdemeanor? Or Anything else in general that I can avoid to a violation in the 3-5 years probation. Please feel free to add on anything related to this subject. Thanks
Fight it. You wouldn’t believe how much damage something like this will do, even after the fact. A lot of people would like you to believe that just because you have been charged with a DUI, then you have to plead guilty…that is just wrong. Tell him to get a GOOD lawyer, not just any lawyer, and fight this tooth and nail. Good luck
It is highly unlikely that it is a condition of your probation that you not associate with people who are drinking (though it probably is a condition that you stay out of bars and liquor stores). If it could be claimed that you were aiding and abetting the person driving under the influence, then you could have your probation violated for breaking the law by doing so. This is probably not a likely scenario, but it is legally possible. However, whether or not it might be a probation violation, why in the world would you get into a car with a person who is DUI? Your personal safety should be more of a concern than a probation violation.
What is the best course of action for a first offense dui in WI?
My brother was arrested for his first dui offense in WI. He blew a .098. They want to charge him with three violations which total up to 15 points on his driver’s license. I would like to know, from anyone, is there anyway we can save him from losing his license? And if someone was successful with keeping their license, how they did it? And what should we prepare for legally? Any and all help is appreciated.
