You should not report a DUI charge on a job application.

Some employers may have legitimate reasons to inquire — If you are applying for a job as a truck driver, for instance. Keep in mind that most employers will perform background checks, so this detail may surface anyway.

Required to list DUI charge (no conviction) on job application?
I was charged with a DUI a few nights ago. However, I am going to fight it and have yet to go to court, etc since it JUST happened. Problem is, I have a job interview in a week. I was wondering if I must list this on the job application even though I have not been convicted of it and it’s still going on???

Should there be a National Drunk Driving/DUI List?
In America we are concerned with protecting ourselves from Crimes and acts that can lead up to them. For instance we have laws that register every sex offender in America to keep our kids safe. However, if you look at National Statitics over 16,694 people were killed in alcohol-related crashes – an average of one almost every half-hour. Many of these being children. So I think that if we are going to protect our children from one class of people, then we should also look at Drunk Drivers who tend to kill a lot more.

Woud a DUI offense be required to list on a job application?
They cannot hire anyone with a misdemeanor until 2 years after conviction. Its been over 2 years since my DWI which was reduced to “driving after illegally consuming alcohol” (given to persons under 21) which is also a misdemeanor.
They do a background check and are going to find this out anyways , so my questions are:
    1. Do I have to write this down on the application?
The application asks you to “specify criminal charges. For all other answers, fill in the disposition/comments section”
    2. I dont know if its considered a traffic or criminal violation?
    3. I am afraid they will not hire me, I previously applied 1 year ago and they told me after I got the job that b/c the background had a misdemeanor I have to wait 2 years. Ive waited but I am nervous they wont want me anymore. Does this mean I have to pay for this every single time I apply for a job (i know i did something wrong but Ive learned and I dont want to still be paying for this 10 years from now)
    Thank you for your help

It would depend on where you want those attorney’s to be and without that information it is impossible to find a list but all you have to do is type DUI attorney and your location into the search bar and you will get a list some post their e-mail some don’t.~

If they are going to do a background check anyway, check “yes” under convictions and include an explanation.

At my company, if you come clean on the application it isn’t held against you if it is not job related. A DWI at my company, unless your job involves driving, usually does not have any bearing on employment.

Yes, there absolutely should be. There should also be one for drug convictions. After all, most of the heinous crimes committed lately against children were by people abusing drugs. Some were registered sex offenders and some were not. Joseph P. Smith, a cocaine abuser, was sentenced to death yesterday in Florida for murdering Carlie Brucia. He said he had used heroine and cocaine prior to abducting, sexually assaulting and killing her. He was not a registered sex offender. All of his past (24) convictions were for drugs.

The sad thing is that drunk drivers and drug abusers have a MUCH higher recidivism rate than sex offenders! So why are we wasting our tax dollars on the wrong people???

Please read the U.S. Dept of Justice report that was issued in 2003. It gives you these rates. It blew my mind away. If we want to issue cruel and unusual punishment it MUST be to all criminals, not just one class.

Thank You for this great question.

P.S. To the young man who states he is 17 and just got a DUI. You were lucky. It could very well have been consensual sex with your girlfriend while you were drinking and then she cried rape or her parents found out and pressed charges on you. You just really don’t know how lucky you are. Many 17 year olds are on the sex offender registries. Check FL, OK, KA, WI, IN, IL and DE to name a few. See how many young people are listed on there for statutory rape among other things that really mean consensual sex. Check ID’s of girls BEFORE you get near them. Also check the moral outrage link I have provided so you will know how to protect yourself. There is a link on the home page to the AOC (age of consent) for each state.
