How Can I Clear My DUI Record?
you may have some options available to clear your record. Your first option after a DUI conviction is to seek a new trial from the court. If there was an error in the admission of evidence at your trial or some other procedural problems, your attorney can ask the court for a new trial. If the judge grants your request for a new trial, you will be allowed to present your entire case again, this time before a new jury. If you're found not guilty after your second trial, then your record will be cleared and the legal effect would be as if you never were convicted. If the judge refuses to grant you a new trial, or you lose at your second trial, you may be eligible to appeal your DUI conviction. If there is an error of law at your trial, or the jury completely disregarded the facts, you may have grounds for an appeal. An appeal involves filing briefs with the court and an oral argument-you will not be required to appear or participate in the appeal. If your appeal is successful, your conviction will be reversed, and your record will be cleared.
The Truth about Lawyers - Even though lawyers are the brunt of a lot of jokes out there, they really are in the legal industry to help you. You could hire one of the most expensive lawyers out there to represent you for your DUI case, and you will still pay less money to him than you would to the court system. If you had the option to pay a certain amount of money to the court, have your license taken away, have to go to jail and spend a weekend at a conference where they describe to you how bad drinking and driving is... OR, pay a lawyer a smaller amount of money, have a good chance of keeping your license, have a better chance of having the DUI dropped and to stay out of jail, wouldn't that be better?
What exactly is the DUI law in California?
I know that if you’re over .08% it’s automatically illegal. But supposing your alcohol content is less than .08%, how do they decide whether you’re guilty of DUI or not?
They call it DUI, driving under the influence because you can be under the influence with any amount in your system where as DWI, driving while intoxicated you must be over the .08 to be considered intoxicated, if the officer determines you are impaired you can be charged.{}

What do you think about the change in the DUI Law that now goes back forever with no cut-off period?
The law now will go back forever, changing the rules in the middle of the game. If you have not had a DUI in 20 years, that old DUI will count if you get another one.
It seems a bit much. At some point in life everyone should move on, I dont think you should be punished for a crime forever.
Of course, DUI offenders should be shot after failing a sobriety test. Random Shooters? suggests pre-meditation meaning it was not their fault and society has failed them and they should be compensated.
What year was the dui law passed?
What Year was the dui law passed that prohibited drinking and driving?
Virginia. I thought maybe it was one federal law.
Which one? Assuming the US, there are 50 different STATE laws. All of then have been amended more than once since they were originally passed.
How does the new DUI law in NY compare with recklessly firing a gun into a crowd?
Because the risks to the public are MUCH greater for DUI than for a random shooting, shouldn’t the punishment for DUI be much harsher?
John: Good one — “guns are evil.” You’re kidding, right?
Think about it — ask class members if they know of anyone who has had a relative or personal friend murdered by a drunk driver or driver under the Influence. It is those stories of loss (and the memory of those special people murdered by Drivers under the Influence) that will sway the argument to make the laws even tougher.
What do you think about our DUI law?
I have a really great writing teacher that says that the USA’s DUI limit law is ridiculous and should be raised. He uses ancedotes such as his friends getting pulled over but could walk in a straight line and touch his nose. Personally, I think he is wrong because I feel so many people can barely drive SOBER, to raise the DUI limit is encourging more people to DUI. What do you think? He also says that police only lowered it so they can catch more people to meet quota. I told him, he should not attack the law, but attack the person enfocing it. You? He is a writing teacher teaching SAT class. Teaching 14-17 years olds.
oh.. and by the way.. he drives DUI too. And when i tried to rebuttle him with deaths and etc, saying that the law is there for a reason, he said that “if you want to go live in Nazi Germany, go RIGHT AHEAD.” which really offended me because he just called me a NAZI. and i’m asain. then he said, “hey, i’m 37 and your 15. I know more than you.” he makes me REALLY super mad and i told him, even though the thinks he can drive w/ 10 beers in him, he cannot make the judgement for everybody else and since he DOES have 10 beers in him, he probably thinks he can, but actually can’t.
