Pulled over for DUI in Los Angeles? Don't give the officer and explanation!

Police officers hear numerous excuses from those they arrest for DUI. Often citizens feel the need to offer the officer an explanation for why they have been pulled over. This is not your job. You have probably heard the Miranda expression that "anything you say can be used against you in a court of law." This is true and you bet that officer is going to testify to what you allegedly said. Do you really want your explanation of, "I just had 3 or 4 beers" or your post FST statement of, "I can't even do that test sober" to be used against you? Anything you tell law enforcement is ammunition to fine you, take your license, make you attend alcohol treatment classes and lock you up. Furthermore, the officer needs to have probable cause to pull you over in the first place. If there was no probable cause to stop your car then your attorney should run a 1538.5 suppression motion to get the evidence thrown out and your case dismissed. Remember, the only reason law enforcement wants to talk to a private citizen is because they believe that you are either one of three categories: (1) a victim, (2) a suspect or (3) a witness. Odds are when they pull your car over that you are a suspect. Politely hand over your license, registration and insurance information. Don't give them an explanation!

    Fines for a DUI in Los Angeles are a little bit complicated. The minimum is $390, and the maximum is $1,000.00. Most prosecutors will offer to give you the minimum if it’s your first offense.

    However, the state imposes a tax of 171% on each fine. The county also has fees of $37 for alcohol processing reimbursement, $50 for alcohol abuse prevention education, and the state imposes a mandatory $100 contribution to the state restitution fund (a state run charity for victims), and a courtroom security fee of $20.00.

    So your total is typically between $1,500 and $1,600 total.

    You’ll have to pay a fine, get some probation and complete a post-conviction course on the dangers of drinking and driving before you get your license back.

    Does anyone KNOW the jail time for a DUI in Los Angeles, CA?
    I am thinking of doing jail time instead of having to pay the hefty fines and fees. This is my first offense.

    When you get booked for your DUI your in until you blow all zeros such as .000 after that you have to serve 48 hours. Then you get to pay the fines, and alcohol classes no more jail time though sorry but you gotta pay

    If she “got busted”, then there is no point taking it to court. The police have to make some pretty key mistakes for you to win against it.

    Your friend is a danger to society and deserves what punishment they get. In some countries you get executed on your first DUI.

    A DUI is definitely not something you want to deal with yourself, You need to act fast to get your drivers license back as soon as possible, I highly recommend Jack Swickard. He helped me out twice on DUI’s and later got them both expunged. (949) 261-0694

    Need a good DUI lawyer in Los Angeles who is trustworthy. My friend got busted for a DUI and she can’t find anyone she likes, trusts, or who isn’t asking for $10K for trial!
