APC, DWI and DUI Driving in Canadian County

Author: Jeff Paul

In many US states, DWI is used as an alternate term for DUI. Driving in Canadian County, though, while under the influence of alcohol can trigger either a charge of DWI or DUI, which are two different types of offenses in Oklahoma. DUI lawyers in the state are well-versed in the differences of these two cases, in addition to a third type of drunk driving case, known as APC.

Oklahoma is among the states that have the "per se" law, which means that a case may be filed against a driver based solely on the individual's blood alcohol content, regardless of the actual capacity to drive. In essence, a driver whose blood alcohol content or BAC reaches .08 percent triggers a charge of DUI.

The penalties for DUI conviction in Oklahoma include fine and imprisonment of up to one year. There is also the possibility of having to go through alcohol treatment if the BAC reaches at least .15 percent, as well as the installation of ignition interlock devices on all the driver's vehicles and community service of up to 480 hours.

In contrast, DWI is considered a lighter charge in Oklahoma, being filed against drivers with a BAC below .08 percent. As such, a guilty verdict for DWI usually brings in lesser punishments, but they may as well be severe.

Lastly, Actual Physical Control or APC is a closely related charge to a DUI. Driving in Canadian County or in the other areas within the Oklahoma jurisdiction is not a requisite, though, as opposed to DUI. It is even usual for parked drivers to be arrested as long as they are under the influence of alcohol and/or drugs, and are in a position to readily drive or operate the vehicle should they want to.

It is best for anyone arrested for drunk driving in the state to have Oklahoma DUI lawyers explain the subtleties of such cases and provide assistance in navigating its complex judicial system.

California law says that for a second DUI conviction the fine should be at least $ 1700 but not more than $ 2500.
A second DUI also has a mandatory 18 month DUI school along with be a license suspension of 18 months as well. You should also count the time you will spend doing community work and other things that will come up and will likely make the fine at least 3 times more expensive than the original $ 1700 – $ 2500

Good luck and avoid DUI convictions, they will hurt you FOR LIFE

  2. Chicho says:

What is the fine for a second DUI in California?
What is the fine for a second DUI in California?
Is it more expensive than the first DUI fine?

  3. John S says:

First, if you have a probation officer, contact him ASAP and find out what happened, since the PO should have set up a payment schedule. If you do not have a PO, you should contact the attorney who represented you, and then go to court. Voluntarily appearing is a LOT better than getting arrested. If you have the money for the fine, bring it with you.

How much will the California DUI fine be?
So, my husband got into a car accident. He got a DUI. There was no other car involved. But the thing is he has a commercial drivers license. But he was not on a commercial vehicle. Since he has a commercial drivers license will the fine be more? We live in California. How much will the fine be about? Also how long is the drivers license usually taken away for? Also, how many points go on your record and how long do they stay there? Will he ever be able to have a commercial drivers license again?
    Thanks.

You can compare how the insurance quotes would change, for example here – autoinsurance.noneto.com

  7. Peedlepup says:

Are you sitting down? In California the average cost of a DUI including all the other fines, alcohol classes, attorney fees etc runs about $7,500 to $10, 000.

He won’t loose his CDL per se, but he would be restricted to driving to and from work. His biggest problem will be if his employers insurance will still cover him. He may loose his job over this.

  8. Jamie lynn says:

I think they give you a certain amount of money per day served in jail. You would be in the klink until your debt is paid off, and that could be a few months. The court may also work out a payment arrangement in lieu of incarcerating you do to overcrowding in the jails.

  9. Doze says:

how long do you go to jail for inability to pay dui fine?
I live in California by the way.

The DUI fine here is roughly 2200 dollars for your first offense. If you can’t pay it the court will usually say you can get Sheriffs Work Project which is like basically working off your fine but it still costs you like 40 bucks a day to do it. So instead its like you are paying 500 plus your work instead of just the 2200. What if you can’t pay your fine? How long are you sentenced to jail?

  10. Carlos says:

Cant afford to pay first offence dui fine, what happens next?
Was charged with a first offence dui. Was ordered to pay a fine but unable to do so after the time that was given to me to pay.
