California Dui Expungement: What are the Benefits?

If you're arrested and charged with a DUI in the state of California, it is highly likely that the incident will go on your criminal record, or "rap sheet". However, there is the possibility that you can get a DUI charged expunged. An expungement has different definitions in every state, but generally it is a formal process of deleting or clearing a DUI charge from your record. However, due to the drunk driving laws being different in each state, it's important to consult with a drunk driving defense attorney to get help with your DUI case.

In the state of California you can get the DUI charge expunged after completion of probation. However, keep in mind that a DUI charge or conviction in California will not necessarily be removed permanently from your criminal record. Furthermore, if you have a second DUI charge within ten years, the first DUI incident could still be used as prior conviction. For example, if DUI #1 is expunged but later the person is charged with another DUI (#2), it will still be considered a second offense.

Benefits of a DUI Expungement in California

So what then are the benefits of a DUI expungement if it can't be completely removed from your record?

2. You do not have disclose the DUI charge when applying for a job with a private employer. However, if applying for any government or state-related position, it must be disclosed.

    dui expungement?
    i pled nolo contendere to dui in June of 2006. The main reason for doing this was because I was in the military at the time, and i didnt have the money to fight it, and i didnt want to have to worry about going back to court. to be honest, i was guilty, but so are alot of other people who hire an attorney and pay there way out of it. my question is, since i pled nolo back in 06, can i go back and try to get it expunged or reduced to a lesser violation now. It happened in Georgia and I was driving on a Missouri license? andy advice?

    An expunged DUI, means that its gone off your record. No one can use it against you.
    You have to get the expungment yourself, they wont take it off unless you tell them to.
    It then bocomes sealed to the public, and no one will ever know it happened. It can also never be used in court against you.

    in CA the dmv thinks they’re god. the consequences of being ACCUSED of DUI are the EXACT SAME as if you were CONVICTED when it comes to dmv punishment. you had the right to a pro tem hearing over the telephone within 30 days of your arrest. if you neglected to have this, or if you lost this hearing, you shit out of luck. your criminal expungement covers just that, your criminal background. your dmv record will reflect the dui for 10 years. you shouldve just killed someone…it wouldve been less punishment.

    No, you don’t have to report this criminal conviction, that part is gone…unless you get another one. once it’s expunged you only have a bad driving record, i think 3 points? not sure how many…the only way they would be able to find out about your situation is if an employer were to run your driving history–which i doubt they’d do unless it was a driving job–the big give away to this is if an application asks you for you CDL#. most job ap’s don’t ask for this info unless they’re planning on getting your driving history. i found it extremely funny that there are literally people out there who have taken their dui case to trial, and been aquited…but who still have to pay the dmv price for the accusations. they operate completely independently of the justice system, and will only give you the answer that driving is a privilege. ha.

    CA DUI expungement affect insurance rates?
    I received a DUI back in July of 2001, and it has been affecting my insurance rate ever since. Under the new DUI laws the DUI I received (a misdemeanor) will be on my record until 2011. I qualify for expungement of this record. My question is if I do expunge my DUI will my auto insurance company be able to see my dmv record and will my insurance company be allowed to charge me the same rate?

    I think it would depend on your record and your negotiations during the case. I know you can get traffic tickets taken off and i believe other things can be too, an attorney would have to look at your history and case and work with a judge to see if this could be done, NOT everyone can do this, it is a case by case thing

    CA DUI expungement and dmv record?
    I received a DUI back in 2002 in Napa, CA and the Napa courts probation has passed last year and I have expunged it from my record. My question is, DMVs probation is for 10 years which is another 4 years away……does this expungement clear up the DMV record as well and remove their probation?
    So, does this mean you still have the put the DUI on job applications until the DMV probation expires? Or can you still apply for jobs without putting the DUI down since the criminal portion has been expunged?
