Most people do not plan to become inebriated and get behind the wheel of an automobile. Some situations present themselves because of poor planning, but some people are trapped in circumstances that leave them as the designated driver when they don't want to be.
Of course, everyone must be responsible, especially when driving a car. No matter how a person ends up breaking the law, that person knows that the law was broken. Even under the assumption that a person does not understand you cannot drive under the influence, which is a huge stretch, ignorance of the law is not excusable.
After getting past the question of right or wrong, the more important factors in the case are how severely handicapped the person driving was and what the outcome of the mistake was in the way of damage or injury.
A lawyer can only work with the situation at hand. If the client caused property damage or hurt another individual, it is much more difficult to resolve the issue without monetary and personal setbacks.
Factors that a judge or jury will be concerned with in a DUI case are:
* The history of the person who is arrested - A first time offender should have consideration given to the number of years of driving experience without moving violations and accidents they had prior to the violation.
* How the driver presented himself or herself at the time of the arrest - This has to do with the severity of the intoxication as well as how the person responded to the officer. Arrogance or fighting doesn't garner much sympathy from a judge or jury. If the person tried to escape in the car, endangering more people, the punishment will be more severe.
* Explanation of why the driver broke the law - Although there is no legal way to justify a DUI, extenuating circumstances might sway a decision if the defendant had an emergency situation that required an attempt to drive.
* Driver's presentation at the trial - Humility is the best cloak to wear when in a DUI trial. The person who wants to become defensive is playing to the wrong audience and probably sealing his or her doom.
Insurance companies do not respond fondly to DUI convictions. Even if an insurance company chooses to allow a person to keep insurance, it will be at a high premium. Most companies will just cancel the policy or remove the driver from the list of covered individuals.
It is best to stay out of a DUI situation, but if it does occur, the only option is to get an attorney who is well versed in that aspect of the law and who will attempt to get the best judgment for the defendant. Attempting to represent one's self is usually a monumental mistake.

He was suspended for a year(dui and other alcohol/ drug related activities).. and has to stay out of trouble until July 11th..as a rookie he was one of the top tacklers on the team and also had five interception at middle linebacker.

But he Blew .11 and they took him to jail and he has been there for a week now!!! He has one stupid petty theft in Cincinnati but that is all the priors he has.. HOW MUCH TIME WILL HE GET!!!!!!!?????? Plz help he is the main care taker and money maker and I need serious answers!!!! PLZ!!!!!!!!!!!!
I’ll check with MADD, but I don’t think there is a stipulation that says if you receive an award from them, you can’t be charged with DUI.

Cincinnati Police Officer’s Blood-Alcohol Level Tested .08
AURORA, Ind. — A Cincinnati police officer was jailed Thursday morning, charged with driving while intoxicated.
Charles Bebee, 53, was arrested in Aurora, Ind., around 11:30 p.m. Wednesday.
A police report stated that an officer spotted a sport utility vehicle moving at a high rate of speed, then a car behind the SUV stopped to tell the officer that the driver of the SUV was going to cause an accident.
The officer followed the SUV for some time before pulling it over for doing 55 in a 35 mph zone.
The report said the officer gave a field sobriety test to Bebee, who failed it. The report said Bebee consented to a chemical test, where his blood-alcohol level was determined to be .08 percent.
Police said that Bebee was charged with operating a vehicle while intoxicated and operating while intoxicated with a blood alcohol content of .08 or higher.
Mothers Against Drunk Driving presented Bebee with a Top Cop award earlier this year.

It seems Thurman is done as a Bengal. Marvin Lewis has been mum on the Thurman subject with the media.
I had hopes for him, but with the signing of LB Edgerton Hartwell from Atlanta I don’t think Cincy plans to have him on the team anymore.
I hope Odell can clean up his life and move on. He still has the chance for a great career if he gets his head on straight. If not, I don’t think he’s a guy the Bengals want around influencing younger players.
Hopefully Pollack can come back, and don’t forget about Ahmad Brooks, the Bengals’ third round pick in last year’s supplemental draft. He plays MLB just like Thurman. If Brooks has it together he’s pretty much a first-rounder based on his talent.

The NFL needs to be more punitive with players who commit crimes. I feel that if the NFL is willing to look the other way on criminal behaviour within the establishment, more and more teams will suffer. For instance, the Cincinnati Bengals have a notorious reputation for crimes of drugs, DUI, and other illegal activities. How can the team perform when the players are repeat offenders? How can the fans be expected to support them or sponsors to take these teams seriously? If the crimes were treated with the seriousness they deserve, and the NFL stops rewarding bad behavior, I believe the franchise could survive.

The Cincinnati Bengals arrest record it terrible. Many of the Bengals have crimes from drugs, DUI, and other illeagle activities. Many of these crimes can result in suspention from the team, or even jail time. This is hurting the overall team by taking good players away and making the franchise look bad. The NFL needs to crack down on punishments for many of the crimes comitted from stupidity. With more harsh punishments, the players should not commit the crimes as much and change the public’s opinion of the NFL and the Cincinnati Bengals.
