DUI Breathalyzer Tests - What Can and Cannot Effect Results

The breathalyzer is a key test in the drunk driving stop. Fail to blow below .08 and courts in many states will rule you are impaired per se and driving drunk, forcing you to then prove your innocence. The question for many is whether these results can be affected artificially.
The myths floating around bars and television shows are legendary. There are a host of sure thing theories on how you can cheat a breathalyzer test if pulled over. If it was really so easy, do you think the devices would be used in every state? The truth is, most of the supposed secret strategies don't work because they don't even address how a breathalyzer determines your blood alcohol level.
From onions to breath mints to licking batteries, the different approaches to beating a breathalyzer test are both humorous and inaccurate. A breathalyzer does not measure the smell of alcohol on your breath! It measures the amounts of alcohol gas in a breath. Modifying your breath with onions or mints does nothing to adjust this. The battery approach is just bizarre and definitely doesn't work.
In an ironic twist, the popular picks of mouthwash and breath spray actually make things worse. Why? These products improve your breath by killing the bacteria in the mouth that smell bad. What do they kill it with? Alcohol! If you take a couple of hits of breath spray before getting on the road, your blood alcohol level is going to be through the roof. Studies have shown that it can be as high as .50 for up to 20 minutes after using breath sprays in particular. That's a lethal dose!
There is one simple way to beat the breathalyzer and it works every time. Pull out your phone and call a cab! Consider the cost benefit analysis. for a cab ride or ,000 for a defense attorney, court fines and so on. The cab ride looks like a very good investment.
if its a law that takes effect on that date they can’t make you do that
when they passed that Law in Illinois last year there was about a 3/4 month grace period before it took effect
mainly to clear out all the older cases before that date,, and after the grace period it to effect for all DUI’s

here in Illinois you pay for the installation around $1000 and $100 a month fee and then pay to have taken out after you receive the paper work saying that you can

This a very interesting question that many lawyers get wrong.
In the state of California, if you fail to contact DMV or lose your DMV hearing on a refusal case, even if your case is dismissed or acquitted in court , that means “not guilty,” it will not overturn the DMV decision to suspend your license.
Got to love DMV law!

How long does it take BMV to suspend license after arrested for DUI and refusing breathalyzer?
I was arrested last week and as of today my license is still valid according to the BMV. Keep in mind I have to appear at FEDERAL COURT, and do not yet have a court date. I heard somewhere that since its federal court, it wont be suspended until I appear in court.
How can you not get charged with a DUI after failing a breathalyzer?
Passed the field tests but blew a .129 at a checkpoint. I thought I was going to jail but the officers just parked my car and made me take a cab. They kept saying I was lucky as if something I had said or did before the breathalyzer test prevented them from charging me with a DUI or arresting me. I left feeling stupid, grateful, and totally confused. Why could I have been let go?

because they would still be a minor, can they refuse a breathalyzer test if there was no probable cause and no reason to suspect intoxication?

As for the other poster’s comments about checkpoints: No, there is no debate about the legality of checkpoints. That was settled in court a long time ago. And no, there is no legal requirement to announce them in the newspaper before hand.

You aren’t citing anything in your post that says announcements are required. It just says they are announced. In CA, there is established case law stating no newspaper announcement is needed.
Being a minor has nothing to do with it. If you are driving a motor vehicle, you agreed to submit to a breathalyzer test when you received your license. If you refuse, you will have your license suspended and they can use your refusal as evidence to point that you were intoxicated. If it is a DUI checkpoint probable cause is not necessary and they can test anyone that comes through the checkpoint.
If it’s Federal, you won’t be suspended until you go before a judge.
Can I get my license reinstated if I refused a breathalyzer, but my DUI charge was dropped?
I got a DUI last night and I refused the breathalyzer. Because I refused the breathalyzer my license is automatically revoked for a year. There is a chance I can have the charges dropped, but I dont know if I will be able to get my license back if the charges are dropped. Thanks for the help.
