    Did being illegal actual help this illegal in his drunk driving case undue favoritism towards an illegal?
    Tearful jurors apologized to the families of the victims after deciding a drunk driver was not guilty of murder in an accident that killed three people. Jurors decided the man was guilty of the lesser charge of manslaughter.

    One of the families slammed the jury, saying jurors didn’t understand the law and showed “undue favoritism towards an illegal immigrant with no driver’s license, who had an outstanding DUI warrant.”

    The verdict came Friday in the case of Erculano Sanchez Hernandez, 24, of Delano, who caused a New Year’s Day, 2010 Highway 46 accident.

    Hernandez was found guilty of three counts of DUI vehicular manslaughter for killing Richard Jung, 21; Jung’s mother Hyun Kim, 49; and Carl Logan, 71. Logan’s wife, Vivian, was severely injured but recoverd.

    “We are frustrated by the decision of the jury,” said a statement from the Logan family.

    “After speaking with the jurors, we feel that they had a lack of understanding of the law and undue favoritism towards an illegal immigrant with no driver’s license, who had an outstanding DUI warrant but received sympathy because of contrived ignorance.

    “While ignorance is never a defense for breaking the law, it was allowed and accepted by the jury in this case,” the family’s statement said.

    According to court documents, Hernandez was driving east on Highway 46 near the Kern County line when he rear-ended Jung and Kim. Jung’s vehicle was pushed into oncoming and collided with Logan’s vehicle.

    Prosecutor Robert Murray argued Hernandez’s actions demonstrated a “wanton disregard for human life,” and made him guilty of second-degree murder.

    Defense attorney Michael J. Webb told jurors Hernandez was guilty of manslaughter, but there was not enough evidence to prove he was guilty of murder.

    Jurors agreed with the defense attorney, but only reluctantly.

    The jury foreman, whose name was not released, sobbed as she read a statement extending condolences to the families of the dead.

    The attorneys don’t ask you the questions, the Judge does.

    They usually ask whether you know about the current case, whether you have heard or read anything about it, whether you are available to serve on the jury panel for the next X amount of days, or for how long the case will take. That is all i can remember, but they ask you a few questions.

    Your past criminal record can make you an impartial jury, since as you said you might be relating to the D in some way.

    As for you to be a jury, it is a long process until you are actually on the jury panel. When you get your letter from the mail, you will be waiting in a room with other ppl who have been called to serve as a jury, and then you will be given a number, and then you will be transferred to the courtroom, where the Judge or the bailiff will call out your # to come to the jury panel. I was the 2 one to be called on the jury panel, i was so honored, since it was out of about 50 or so ppl. Lol. Once you serve on the jury panel, it is the greatest feeling ever, seeing the court process, you will enjoy it.

    Underage drinking is wrong. Drinking and driving is wrong. Causing bodily harm, or a fatality as a result of drinking and driving is UNFORGIVEABLE!

    I hope the young man learns from this event and never lets it happen again.

    What Questions Will the Lawyers Ask Me for Jury Duty?
    I received a letter saying I have to report to jury duty.

    What types of questions are the attorneys going to ask me?

    Also, I have a drunk driving and underage drinking conviction from when I was a teen, do you think defense attorneys would want me because I may “relate” to the criminal? (having been thru the criminal courts myself)

    Allright everyone, seriously I am not a Paris fan at all, however, she does not deserve the treatment she is getting. I am a daughter of a defense attorney, and growing up I have had a few friends caught driving drunk. NONE served jail time other than that night, and yes, 2 did get caught driving again with the suspended license, just as Paris, and still did not serve jail time. So come on, she is a frek and famous for nothing, but she does not need to be in jail because the judge is on a power trip. If this was someone close to you, you would be fighting for that person to be set free. Stop hating just to hate………….

    Yes I have lost my best friend 2 years ago to a drunk driving accident in AZ. Different case than, she did not kill anyone, she is in trouble for driving with a suspended license, that is the only charge. do youwant to spend 45 days in jail for that charge?

    Harvey J. Miller, 43, who has no legs, was steering the 1985 Chevrolet truck from the driver’s seat while Edwin H. Marzinske, 55, operated the brake and gas pedals, according to the police report.

    They were headed northbound on Hiline Avenue in Abbotsford when police pulled them over at 2:40 a.m. on Aug. 18.

    Miller admitted he was too drunk to drive but argued “I wasn’t operating the vehicle because I couldn’t push the pedals.”

    According to wikipedia: Driving is the controlled operation of a vehicle, which is usually a motor vehicle such as a truck, bus, motorcycle, or car. For bicycles and mounted animals and— at least in the U.K., the U.S. and Canada, —motorcycles, the corresponding activity is called riding.

    so technically, both were DUI.

    I’d ask for a jury trial (because now you have 12 chances of being found not guilty, even a hung jury). Then I’d argue that NEITHER was in control of the vehicle and play on the sympathy of the jurors about the loss of my clients arms and how difficult life is him. I wouldn’t discuss the DUI much, only his “issues”.

    If OJ can be found not guilty of double murder, these guys can be acquitted of DUI.

    The only thing that could be better is if one of them was blind and they needed that 3rd guy to tell them where to go!!!!!!

    The 17-year-old driver — who was not hurt in Sunday’s crash — is charged with vehicular manslaughter with gross negligence while intoxicated and two counts of DUI causing great bodily injury.

    Defense attorney Robert Bourne argued unsuccessfully that the boy should be released to his parents, because he is an “exceptional student” and has no history of problems with school administrators.

    The high school senior is also a star athlete who just a few months ago made the San Diego Hall of Champions All-League team for lacrosse.

    Deputy District Attorney Aimee McLeod told Judge George “Woody” Clarke that the youth may have a drug problem, and that his parents had been testing him for drug use.

    McLeod added that right before the accident, the teen was speeding and that his blood-alcohol content was 0.10 percent about an hour after the crash.

    The boy wore a Juvenile Hall-issued orange shirt and navy blue pants at today’s detention hearing. His hands were shackled and he did not look at his parents in the courtroom.

    When the judge asked the boy’s parents if they wanted to say anything on behalf of their son, the father declined and deferred any comment to Bourne.

    Prosecutors said the teenager will not be tried as an adult.

    McLeod declined to elaborate on what the teen faces if he’s convicted, but did point out the difference between juvenile and adult court.

    “In adult court, the focus is punishment,” the prosecutor said outside court. “In Juvenile Court, the focus is rehabilitation. Regardless of the crime, we are very focused on the minor and the family. Some consequences are custody, some are programs and sometimes it’s a combination of both.”

    A California Highway Patrol report said a combination of alcohol and speed contributed to the pre-dawn accident.

    Alexander Michael Capozza, 17, died about 1:40 a.m. Sunday in the 5000 block of La Granada in Rancho Santa Fe when the speeding 2008 Mazda 3 crashed and rolled several times, ending up in some bushes, according to the San Diego County Medical Examiner’s Office.

    Another passenger — who was not wearing a seat belt — was critically injured in the accident, while the other two 17-year-olds escaped serious injury, authorities said.

    CHP Sgt. Lewis Hall said his agency and the state Department of Alcoholic Beverage Control are trying to determine where the students had been drinking, how they may have acquired the alcohol and if adults were involved. He also said illegal drugs may have been a factor.
