The point is that you must never justify, exaggerate, and change any fact in front of your attorney. Just provide things that you remember to be the truth. Your attorney will help you with your case no matter what has happened before. However guilty you might be, they will still give you legal advices, getting you the defenses, and honestly telling you about possible resolutions.

More honest information from your part will be resulting in better defenses from your defender. But if you lie, you cannot expect a good relationship between two parties since there will be no trust. This can lead to unfavorable outcomes that will make you less happy in the end.

The proof is everywhere: In the courts of criminal cases, right or wrong sometimes does not matter anymore. The only valid things are witness credibility, constitutional questions, or best evidence. If the trial has only two witnesses, one from each party, the winner of the case usually is the party that can provide the witness who can tell better story and presenting facts more consistently.

So, help your lawyer finding better defense for you by providing him the details, alibis, witnesses, and corroborating information. If you are not anywhere near the crime scene when it happened, provide proof. You can show restaurant receipts, contact, toll slips, property titles or maybe statements from your associates.

You must not be complacent when you are accused for things that you did not do, even if you cannot actually do it. Everything can happen in the court, and the innocent not always win in the end.

    Can a malaysian lawyer practice both criminal defense and prosecution?
    I mean,in malaysia,I want to be a criminal lawyer. But I’m not sure whether can a lawyer in Malaysia perform persecution and criminal defense at the same time?

    Much of what CatLaw said is accurate. I just wanted to add a couple of things. My fiance is a criminal and family attorney, and he is good at it. However, I think that being a criminal attorney would be tough. A lot of the people have no desire to take responsibility for their actions. Their biggest concern is trying to get away with something. Furthermore, some of the people he has to defend are despicable.

    I wanted to add to what CatLaw said about not being sure what type of law you want to be involved in until later on. When my fiance graduated from law school he thought that he wanted to do wills and trusts, and real estate law. However, his employer at that time hated to be in court, so he received all of the cases that had ANY chance of ending up in court. That is how he ended up in criminal and family law. He realized that he liked doing it, and liked being in court.

    I would also add that, while some law schools have very high tuition, they aren’t all that high. My fiance’s loans were for about $30,000 after law school. The average salary must vary by location, because in our state the average for someone who has been practicing for the same amount of time as my fiance is about $50,000. We live in the midwest. (I believe the range was for attorney’s that had been practicing for 2-5 years, though I don’t remember the range for certain. I know that it covered third year lawyers, because he is in his third year.) I cannot attest to how hard it is to find a job, other than to say that when my fiance was looking for a new job last spring, there were not very many advertised, although most that were advertised were for first year attorneys. (They don’t have to be paid as much.) That said, he didn’t have too hard of a time finding a job, and it is a good one too.

    I would suggest speaking with a admissions counselor at a school that you are looking at. Maybe they could help you with the decision, and they could definitely help you learn more about law school, and becoming an attorney.

    I think that performing persecution would be outlawed. One lawyer acting for defence and prosecution at the same time, on the same case, should never happen!

    There will be a duty solicitor at the court who can give you free advice on the day – ask to speak to them. If not, you’ll have to ask for an adjournment to seek legal advice and contact one. The costs can vary depending on the amount of work done – ask about legal aid.

    In the USA, to become a Lawyer, IF you go to school full-time:
    1) Bachelor’s degree – four years from a traditional college/university.
    2) Study for LSAT. Take LSAT.
    3) Law school – three MORE years.
    4) Study for Bar Exam. Take Bar Exam in the state where you want to practice.
    5) Pass the Character and Fitness Evaluation. Then you can practice Law.
    BUT……..
    6) You still have to take additional classes/seminars/legal training etc. each year to obtain CEUs to keep your license to practice Law. (You aren’t done with school!!)
    7) In many states there are even laws requiring a certain percentage of your legal work to be “pro bono” (free of charge) for some charitable purpose.

    There are more attorneys than there are legal employment positions. We simply already have way too many Legal Professionals. AND the legal profession is dramatically changing: it is in absolute CRISIS! And, every year, more and more people graduate from law school, but there are fewer and fewer jobs. Even the largest and most reputable law firms are experiencing unprecedented cutbacks. I don’t expect the situation to improve in the coming years…..

    Be aware of what you are proposing on getting yourself into. Please do more research first. Reminder: WE ARE STILL IN A WORLD-WIDE RECESSION. Obviously, economic conditions affect the number of jobs available. Consider career paths that have available JOBS.< < Even in a Recovery, there are some jobs that just won't return - the field of Law won't make a comeback. Too many things have changed in this vocational field. This is a SHRINKING, crumbling, and dying vocational field. Many, many reasons.

    The field of Law has a mystique that actually exceeds reality. The field of Law is a vastly overrated career - especially by television.<< Law is a more demanding profession than most people realize. It is not like what you see on TV.

    The competition to get into law school is intense. Applicants to most law schools greatly exceed the number that can be admitted.

    Even if you do finish law school, you won't be able to find a job when you are done. Since this vocational field is shrinking (at an alarming rate), many new attorneys/lawyers are, themselves, having to work "down" as Paralegals, Legal Assistants, Legal Secretaries, Bailiffs, Court Reporters, etc, etc, to simply try to keep some of their bills paid. And the competition is fierce in TODAY's job market!

    Now... the law schools know this, but they won't tell you the truth >that the job market/economy is just SATURATED with way too many Legal Professionals. Instead the schools will feed you a fairytale and will LIE to you. The root of the problem is we already have too many law schools. We are STILL in a Recession, and the schools are fighting for their own survival – they will tell students anything to get to the students’ money. (Which is why they won’t tell you the truth about the job market for the field of Law.) And these schools continue to recruit and churn out even more graduates………….Remember>>> law schools are BUSINESSES – their TOP concern is making money for themselves.

    How could one go on to be a criminal lawyer following a chemistry degree?
    Are there any requirements for a law degree? Obviously I’ll have a plethora of scientific qualifications and a degree… I have been assured it’s possible to go on to be a criminal lawyer, but how???

    My wife is a lawyer (in the UK they’re called solicitors). She’s defended many criminals in her career – including murderers and child sex offenders.

    There are two principles here:-

    1. you are NOT permitted to defend a criminal you KNOW to be guilty (i.e. one who has confessed to you that they are guilty). This is termed “professional embarrassment” and the lawyer is obliged to drop the case and insist that the defendant instruct another lawyer who is unaware of the person’s guilt. A lawyer found to have defended a client they knew to be guilty would be committing a serious breach of professional conduct and subject to disciplinary action by the Law Society, which might include a hefty fine or even being struck off.

    2. even with cases where the defendant MAY be guilty it is important to realise that the only way they are ever going to be convicted is if they have a fair trial. This means they MUST be defended unless they choose to defend themselves. It is then up to the prosecution to prove the case.
    You can’t put rapists, murderers, sex offenders or anyone else in jail unless they have been found guilty in a fair trial – which means that SOMEONE must defend them.
    No fair trial means they walk free.
