What could I get for driving with a mid range 0.095 blood reading with two previous drink driving charges?
I am in Sydney NSW Australia. The two previous drink driving charges were over 15 years ago. To get this 0.095 reading I had 2 cans of bourbon and coke and 5 stubbies of VB, that was approx. 8.30pm I stopped drinking and at 3am drove and was then breath tested. I thought I would be ok after 6 hours.

Hi, I’m from the UK and am about to travel to Latin America via Sydney. I want to visit a friend in NY whilst in that part of the world. After much research I found it would be cheaper to get a round the world ticket that went London > Sydney > New York > London and simply book my own flights down through south america flying out from New York. I would need to come back to New York to catch my flight out to London again at the end of my trip. The problem is I have just found out I need a visa because I have a drink driving conviction from over a year ago. I also have some minor charges from 10 years ago for drunken nonsense like reckless conduct and breach of the peace from my early college days when I was about 21. My question is this, will these affect my visa application? Am I likely to be detained and turned away at immigration even if I get my visa? I stupidly booked my flights but am hearing some real horror stories about US airports. Please help with any info if you can!!

The guy i’m seeing lost his licence twice in one night being over the limit before we met. He has now lost it for 18 mths. Do you think it’s that big of a deal? ppl lose it all the time. Is it bad that he still drives around? he doesnt drink drive, but just drives around doing general stuff. but does use the phone while driving……….would most woman stick by them? I still don’t have my licence and he calls me weird for still not having one. but will get it soon. He seems very down about it. What can i do to show him i really care?

Not sure what they might do where you are but in the US they are really strict about that. I have a friend who has had this happen to her she did 10 days in jail but they let her out in 5 days. Good Luck!

For the licence:
These stay on yuor driving licence for eleven years from date of CONVICTION.
DR10 Driving or attempting to drive with alcohol level above limit
DR20 Driving or attempting to drive while unfit through drink
DR30 Driving or attempting to drive then failing to supply a specimen for analysis
DR80 Driving or attempting to drive when unfit through drugs
These stay on your driving licence for eleven years from date of OFFENCE.
DR40 In charge of a vehicle while alcohol level above limit
DR50 In charge of a vehicle while unfit through drink
DR60 Failure to provide a specimen for analysis in circumstances other than driving or attempting to drive
DR70 Failing to provide specimen for breath test

For the criminal record:
-most convictions become spent after five years
-prison sentences up to six months become spent after seven years
-prison sentences up to 2.5 years are spent after 10 years
-sentences over 2.5 years are never spent
Rehabilitation periods are halved if you were under 18 when convicted.
For drink driving, assuming you were not sent to prison but recieved an endorsement, disqualificatrion and a fine, the rehabilitation period is five years.

If your conviction is spent, you do not need to disclose it However, because the post you are applying for is exempt from the Rehabilitation of Offenders Act, convictions both spent and unspent will show up.
Make sure that the post is indeed exept from the Rehabilitation of Offenders Act, otherwise the check is unlawful. Posts that are exempt include those where you would be working closely with children or vulnerable adults, approved posts in the financial sector, security services, taxi drivers and health care work.
