    How is someone charged with DUI, when they weren’t driving?
    A lady I work with was arrested along with her boyfriend who was driving because they were both intoxicated. They were both charged with a DUI.

    How can someone be charged with a DUI (driving under the influence) when she wasn’t even driving?

    She did say she refused the breathalyzer. She said she didn’t feel the need to do one since she wasn’t doing anything wrong.

    Yes! The assumption will be that it was driven there while intoxicated. There would be no problem if it was driven there intoxicated, then sobered up before the cops came. The only charge would be for having an open container in a vehicle.

    I was pulled over and charged with a DUI. I have court next month. In the officers statement, he said the probable cause for which he pulled me over. was me doing 40 in a 35 mph zone. But in actuality it is a 45 mph zone. So he is inaccurate in this. It was raining and storming out so I was going 5 mph under and not over the actual speed limit. Is this a valid arguement concerning the credibility of his probable cause to pull me over? Or should I just take my medicine.
    I had my first court date where I pleaded not guilty last month. They had to extend it because of clerical errors in the charges. For some reason a prior dui that does not exist showed up on my RAP sheet. So I showed the DA my driving record and proof of no prior DUI. I’m not an alchoholic and since this first court date I have been doing the suggested self help meetings the judge ordered me to do. I appreciate any feed back.
    I know for a fact that the officer is wrong in his report. The speed limit is 45 not 35. I have pictures of all the signs and the intersections. South bound is a 35, but north bound which I was headed is a 45. So believe it or not “John”. Police officers make mistakes just like the rest of us. I also believe this prior non existent DUI may have motivated him to pull me over. I believe the implications for which he pulled me over are erroneous. I acquired a public defender, but we do not meet until next week.
    Please no ignorant answers. Many roads have different speed limits determined by the direction of travel. For example.. up and down hills, leaving or entering cities or downtown areas. Approaching school zones. And there are a few different examples. And to The woman that replied. I was going 5 mph under the speed limit on a raining day. The officer stated that I was going 40 mph in a 35 mph zone. Please only reply if you’re a good police officer with a higher IQ than the average. And people who have no idea what the your talking about.. need not reply. I appreciate the people with intelligent answers. Who have read and know the facts. I was a .09. This can be irrelevant if the officers statement is not credible or accurate. You need to have a probable cause. You can’t just pull people over because you think they’re speeding when they don’t know the speed limit themselves. Or am I wrong? Any attorneys out there? I could be wrong.

    My brother and I have a trip planned to travel from where we live in Alberta to visit our sister in California on Jan 14-21. On New Year’s Eve he receieved a DUI charge and his fingerprint date is Jan 26 and court date is Feb 2. As of our date of travel he has just been charged, not convicted, of this crime so will we have trouble at the border? Does this charge show up in their system even if not yet convicted of the crime?

    While it may not be written into law, you can bet that company policy will prevent any such driver from getting behind the wheel. You would be a litigation nightmare for them if you so much as bumped into another vehicle.

    Can you be charged with DUI for standing outside a parked vehicle?
    We went camping at the beach. We were both legally drunk. My boyfriend was standing outside a parked vehicle. I was in the vehicle’s passanger side with the keys in my pocket. There was an open bottle in the vehicle. At no time was the vehicle moving, much less, running. He was charged with DUI.

    His trial is tomorrow and he has a public defender. He is pleading not guilty. Does he have a chance?
