Does a DUI conviction and restrictions apply to all states?

My brother has just had his second conviction for DUI within 12 months in Virginia. In addition to a short jail sentence, his Virginia driver's license is suspended for 4 years. My brother has just had his second conviction for DUI within 12 months in Virginia. In addition to a short jail sentence, his Virginia driver's license is suspended for 4 years. To try to get around this, brother is thinking of moving to Florida or Georgia and obtaining a new license there. Will he be able to do this? Do the terms of a DUI conviction in one state apply to all US states? Will the Georgia or Florida DMV check records for prior driver's licenses if my brother applies for a first-time license?

    Your brother will have to lie and say he has never had a driver's license anywhere else (they will ask). If they don't catch it immediately, the odds are overwhelming that they will catch it eventually.

    Yes they do.

    If he is banned for four years by VA, then he cannot drive, legally, anywhere in the USA for that four years.

    If he applies for a license in any other State, the application will ask "Is your license suspended or revoked….?". If he answers "Yes", he won't get a license. If he answers "No", they check anyway. He won't get a license, AND he'll face charges for lying on the application.

    Your brother will get denied for a new license. State DMVs are connected and they will be able to see his license is suspended in Virginia. His suspension will be applicable in all states and they will be able to see he has a suspended license, so he can't apply for a first-time license.
