What is the process of applying or US citizenship after DUI conviction?
Right now I'm on my 2nd out of 3 years probation period. i had misdemeanor conviction..
As far as i understand i need to apply for Early DUI probation termination California Penal Code section 1203.2, subdivision (b).
But in addition to that: do i need to clear my criminal record?
if that is the case, then HOW do i clear my criminal record?
thanks for your help!
No it is not a felony.
it's a misdemeanor
Does not matter whether it is a felony or not, DUI is a "moral turpitude" offense. You should talk to an immigration lawyer to see what you need to do. Clearing your criminal record is irrelevant. USCIS does not ask if you have a criminal record, it asks whether you have been convicted.
Is it a felony? if it is they will deny you the visa. http://www.justanswer.com. They charge a small fee but is worth it.
