What happens if I act drunk (while sober) at a DUI checkpoint?
I'm curious if there are any crimes or infractions that can come out of acting a little drunk the next time I roll up to a DUI checkpoint. I don't drink and drive (ever), but if I have 0.0% on the breathalyzer but slur my words and creatively fail their sobriety tests, can I be charged with...
I'm curious if there are any crimes or infractions that can come out of acting a little drunk the next time I roll up to a DUI checkpoint. I don't drink and drive (ever), but if I have 0.0% on the breathalyzer but slur my words and creatively fail their sobriety tests, can I be charged with anything? Or will I just tick the police off?
They'll assume you're on something, haul you to the station to hook you to the big machine, then get a court order to take you to the hospital to draw blood and hold you under observation until the test come back. After that they'll go for a psyche screen. Loads of fun. They'll get a laugh out of, and so will you when they send you a bill.
I suppose you could be charged with something relatively minor (at least it's relatively minor when you're NOT the one being charged!) like interfering with a police officer in the carrying out of his or her duties – if they figure it out.
Alternatively, you might just find that you've set yourself up for a battery of tests – mj, mental health, lack of meds, etc.
You sound like a VERY together individual – let us know how it turns out!
What do you think? I dare you to try it!
Disorderly conduct is a possible charge you may face.
try it and when you get out of jail get back to all of how it turned out for ya.
I have no idea but you will have one confused cop when he gets the breathilizer results.
You are likely to find out that police don't really have a sense of humor about things like that….
You can be DUI and NOT under the influence of alcohol….. as in under the influence of meds – prescription or non-prescription.
If you're acting like your DUI, you'll be hauled out of the car and put through the FSTs (field sobriety tests). You'll be asked if you're on any medications, and will be given the local breathalyzer test. If you deny being on any meds and are still acting DUI (ie, stupid), you'll likely be cited for DUI and taken to the hospital to have your blood drawn and tested for other drugs.
While you may not be cited, you're gonna end up in custody until the results come in. It won't be fun ….
Calif Deputy
chances are the officer will assume that the breathalyzer is broken if you have already failed other field sobriety tests. After jerking the officer around, explaining that you were only joking is seriously going to piss him off.
but if you are interested in following through here are a few other things police officers look for when spotting a driver under the influence of alcohol.
