Passengers at a DUI checkpoint.?

I have designated a driver this new years and i was wondering what happens at a DUI checkpoint on new years? Do they pull you out of the car? Do they normally search the passengers? How does it work? What if there are underage people in the car, but the driver is sober? ...

    If the underage people are drunk, they can be cited for Minor in Possession of Alcohol, for what's in their bloodstream.

    If the driver is sober, (s)he can't get into trouble, though.

    If the underage people in the car are drunk they might could try to arrest you for contributing to a minor if you are the legal age.

    They usually just ask the driver questions. I have never been asked to get out as either a driver or passenger. They will only ask the driver to get out if they seem impaired. If you or a passenger are doing drugs and the officers smell it or see it then they have the right to search you and the car. Oh, and if there are open containers of alcohol in your car and it is illegal in your city they also have the right to search.

    Nothing should happen. The important point is "has the driver been drinking" and not the passengers.

    DUI checkpoints are set up for 1 specific reason. To catch drunk DRIVERS, not passengers. However, if the officer has reasonable suspicion to believe that people may be underage or that the driver is in fact impaired then all bets are off for the passengers. Especially if an arrest is made. If ANYONE in the car is arrested then the car can be searched and towed regardless of who owns it.

    in our area they run id checks on everyone in a car they pull over any day just to check for warrants or run aways. They probably won't search everyone but if a minor is drunk they will get a ticket. But as a sober driver if you got them to believe you just got a call to go pick up a drunk friend or relative they might let the driver off. But if not they could charge an adult sober driver with getting the minor drunk.

    since you have designated a driver to be sober why not designate anybody under the age of 21 to be law abiding………you like to be in charge

    It is illegal here in Michigan to have a DUI check point. They violate a person's rights so it is not permitted in Michigan.
