i got a caught with a dui in vancouver back in october. But because the the rookie police filling out the form for dui certificate made a mistake. its been close to 6 months and i still not being charge yet. i heard there is a time limit on how long the police have to press charges before its thrown...

    Thanks for your question. You need to make sure you ask a B.C. lawyer this question.

    Here in California, where I practice, there is a statute of limitations of one year for a misdemeanor DUI, and three years for a felony DUI. If the prosecutor or District Attorney files the case after this, it can be dismissed upon a motion by the defense.

    I don’t know the laws in Canada, but if they are similar to California, then your answer is definitely yes, but you need to seek the advice of an attorney specific to your province.
