


DUI someone please help me, please. Im a minor and charged with d.u.i and so many other charges that my headsp?
Im not looking for a way out of these charges Im just trying to lighten the load, i need to be able to commute back and forth from school and work, i have to in order to sustain my living and help my mom out with my sister and etc. I wish i could explain all of the things that I'm working at/on but ...

Basically, i work a restaurant and when i got off i went to a friend's house and i had probably 5 drinks thinking that i would have some time to sober up before i had to be home, and then time got the best of me and i realized i needed to be home. I then started driving off into the night, i got on the highway my usual route. I was speeding but i thought i was going about 90 or 85ish, i didnt feel i was going fast, i drive a 2005 Cadillac Cts. I got off the exit, on my way home and then my friend called me with some story that he heard from all these people, basically saying that i stole something from him and to meet him at Steak & Shake to talk about it, i turned around at 2:09 and headed to the restaurant which is one exit down from where i live. I finally got to the restaurant and talked this matter over with my friend for about 10 minutes and figured out that it wasn't me & etc. In route to my car i saw 2 police cars pull up, i began pulling my seat back and getting comfortable for the drive and etc... I realized something was wrong, the officers were kind of creepin up on me with no lights or anything, so i got out of my car and asked them if anything was wrong. As soon as i did this both officers got out of their cars and one reached on his side and they were screaming and cursing at me telling me not to move and don't touch anything and to "Shut the fuck up" and not speak. So that's what i did, i stood right there, I asked them to turn off my car & etc. they wouldn't allow it.. The officer asked me for my name and i told him, then he asked me for my i.d and i got my brother's i.d by accident (he left it in my car when i went to florida and i planned on mailing it to him because that would be free and it cost .00 to replace it and he didn't need it anytime soon anyway). They arrested me and threw me in the back of their car, the handcuffs were so tight that my wrists swole and have been red and swolen, 2 days later. They searched my car and found my i.d and claimed that i was trying to impersonate my brother. I tried to explain to them what had happened and they were not trying to hear it, at all. They called my mom and told me that i was driving around 155-ish on the high way but they couldn't clock me because no one could catch me apparently. They also said i saw an officer on a street close to the highway and that i made an immediate u-turn and got on the highway. The officer beat me up pretty badly, he slammed my head against the door frame and while my mom was in route to get me he took me to his headquarters and did something im not sure, he kept slamming me in the chair and every time i asked a question about what was going on, his reply was " Shut the fuck up, Sit Down, and don't say or do shit" i was confused, i wasn't sure what was going on so i then kinda just sat there. He said i refused to take the Breathalyzer even though i tried but he kept saying i refused, he also said that i tried to damage the breathalyzer by pulling apart. I was able to walk on a straight line but that's not anything. * These officers were absolutely awful to me, they treated me like pure shit. All in All these are the charges that i was brought up on, FYI: The officer didn't tell my mother anything about the "10-day rule" or the form where if i signed it i would be allowed to drive for 30-days. He didn't write refusal to sign on the form but he wrote not cooperative.

You are going to need some very good legal representation here. Quite a few serious charges listed and a public defender is not going to fight each charge in court.
Although refusing to take a breathalyzer is not a formal charge, under implied consent law, that will mean an immediate guilty charge of DUI and revocation of your license. Period.
Best and only advice is to contact a good defense attorney and discuss all the charges in this case. It won’t be cheap, but you are looking at some serious time, even if you are a minor.

To be honest you are screwed.
They will smack you with the ID thing. The judge will go after the fact that you did not present your own ID. Most people have that ID in their wallet. It is not just sitting on a seat or anything.
The speed is an obvious thing. You will also have the testimony from two officers and their word will count. I would question the 155 thing…. pull up the specs for your car.
Your mistake was to be driving a high end vehicle at that time of night and speeding. The judge will wonder about that. My bet is the judge will be pissed at your parents.
Refusal in most places means an automatic suspension. conviction and jail. The fine will be enourmous. The cost of insurance later will be as well and your insurance company may drop you. Since you are a minor you are probably on their insurance. The cost to insure all of the vehicles in the household might go up by say 400%.
Sell the car if you can. Have your parents get you a super serious lawyer. You so need one.
