Either its DUI 4th or DUI with injuries, other wise it would NOT be a felony in California!
And to get 16 months, it has to be VC 23558- DUI with injuries punishable up to 3 years in state prison.
Sorry. There are too many drunk drivers on the road as it is, and it's unlikely that the court will be lenient to a repeat offender.
DUI is a serious offense….think of all the people you hear on the news getting killed by drunk drivers….police and DAs have no tolerance for DUI charges
He could ask the judge to sentence him to rehab for the duration of the sentence. But it would be on his dime. That would cost at least $5000.00 a month or more.
A friend of mine was able to do that. He still has the criminal record however. But his life has changed for the better.

Yes, just have him plead not guilty!!! This is important cause once he pleads not guilty they WILL offer him a plea agreement next trial giving him less time in jail and reduced fines! The reason is the state doesn't want to lose the case or money and by him pleading not guilty it makes it harder on them cuz they then they have 2 prove him guilty beyond a reasonable doubt! If there is even the slightest flaw in the case against him, I'd fight it till the end hoping 4 a dismissal!
