    It is my understanding that most states have amended their DUI laws to say that behind the drivers wheel is considered ‘in operation’ of the vehicle, therefore yes you can get a DUI. Some states still have where the keys have to be in the ignition. You will have to check on the laws of your state.

    A highway patrol friend of mine said if you were sitting behind the wheel, keys in the ignition or not, it shows intent and yes you could be ticketed for dui

    yes you can even if you are sitting in the passenger side of your own car letting another drunk driver drive.

    yes like everyone else has said if you are behind the wheel you can be charged, even if you are asleep in the driver seat and the keys are in the backseat of the vehicle you can be charged, not to mention operating any form of transportation you can be charged, ie riding lawnmower, golf cart, 4wheeler, horse, electric wheelchair

    No. The key is the part about keys in the ignition. As long as the keys are not in the ignition, you can not be charged. I know this. I have been through it and won in court.

    Depending on your states laws (yes this will have something to do with it) you can be ticketed for a DUI just for being behind the wheel of the vehicle. However, if you are not behind the wheel you cannot be ticketed for DUI instead you can be ticketed for a Open Container violation, or a PI (Public Intoxication).

    I’d fight this – I think they have to catch you actually moving…. afterall the offense is "driving" under the influence not sitting under the influence.
