    Answer: In Georgia one can sometimes plead "down" to Occupying the seat…This makes the crime a local, non-driving offense…No DUI, no points. Some localities will go along as they get more money for themselves.

    You probably can’t. As an employee of the police dept, I’ve witnessed how detailed officers are while doing DUI investigations. Everything is typed in a log. They have a time trail to follow from the moment you are pulled over. If you were intoxicated it’s best to plead guilty.
