Was pulled over for dui. He got scared and ran across the street, but stopped and layed down. Officer tasered him and mased him. Took him to jail. When they got there, the officer said that he is writing a warrent for slapping him in the face. This is a lie, he did not assault the officer. The...





Was pulled over for dui. He got scared and ran across the street, but stopped and layed down. Officer tasered him and mased him. Took him to jail. When they got there, the officer said that he is writing a warrent for slapping him in the face. This is a lie, he did not assault the officer. The officer has no witnesses, but claims that he does. This would not be on video or audio anyways, b/c the arrest happened away from the police car. I know he needs a lawyer, but what would his charges be? Roughly? He has no background, and was released from jail the next day on a PR Bond.

    A DUI all by itself is difficult and expensive to fight. Your boyfriend resisting arrest by running away wasn’t a good idea. Even if the assault charge gets thrown out, he faces the DUI and resisting arrest which are two very serious charges. His chances of getting out of this without a lawyer? Pretty much zero.

    He will definitely need a lawyer in this case. The lawyer can defend him in many ways. One possible defense is bringing up that the policeman used the taser and mace unnecessarily. In my opinion, that is probably his best hope for getting his charges dismissed. If the lawyer can’t get the charges dropped, the attorney may be able to plea bargain it down to a simple DUI.
