What rank has the power to punish a brand new Army Captain and Medical Doctor who just got arrested for DUI?

This is just his 3rd month on Active Duty. He has never been in the military before. He was a surgeon for 7 years before he joined the Army just a few months ago. The Army gave him a direct commission as a Captain. He went to OBC for 2 months, and had too much to drink at the OBC graduation party. ...





This is just his 3rd month on Active Duty. He has never been in the military before. He was a surgeon for 7 years before he joined the Army just a few months ago. The Army gave him a direct commission as a Captain. He went to OBC for 2 months, and had too much to drink at the OBC graduation party. He drove drunk and got arrested for DUI. What rank has the power to punish him and demote him?

    On most bases, the Garrison Commander usually retains UCMJ authority over officers. There is no specific rank.

    It will start with councilings from his commander, company, then to battalion. From there it depends on the organization, but it will get up to the Garrision Commander. From there the Garrision Commander will decide. It is usaually just a letter of repremand in his file. That sounds like a light punishment, but for an officer it means you will not get promoted and be forced to elave the Army after a time. If you cant get promoted, you have to get out.

    Not a rank, but a position. His commanding officer can conduct Non-judicial-punishment proceedings and can arrange for a court-martial. if he was busted by the civilian cops then the civilian system will also inflict a punishment, in addition to the military.
