I did NOT take the sobriety test. I told the officer I would not do anything without my lawyer.
I dont know if that was a smart move or not, but i know I wouldn't of passed the test.
What are my options looking like?

the accidet was i went over the curb and across a few lanes on the other side of the road. the cops gave me a road test which i didnt pass too well, didnt fall or anything. i told the police i did have a few drinks. someone saw the me go across the lanes, it wasnt that i was pulled over randomly or anything like that. and when the police showed up i was even driving i was just sitting in the parking spaces i stopped in.

for those who think of me as a bad person, i do understand and respect that. i did make a mistake and yes im thankful to god that nobody got hurt and myself second. but i just think about who i could of hurt, or hit another car. it was 2 in the a.m and i was coming home from the bar. did make a mistak i do admit. but im hoping for some leinency, because i am human. i do make mistakes, but i do learn from them. i am a very respectful person, i work hard and just was out on a tuesday night because i cant go out any other nightreally because of work and such other obligations. im not asking forcriticism i am a very hard person on myself and expect great things from me. this is just abump in the road and i do apologize to everyone once again.

Why don't you just take the punishment, learn from it, and be glad it wasn't worse than a DUI ticket?
First off you shouldnt have said that. second of all you knew you were over the limit, which is broken the law.. dude, you just got to pay your dues….

Unfortunately, here in MO a refusal to blow is an automatic loss of license for 1 year. I am not sure if the FL law is the same. Also had you blown it would be on your record and loss of license for 90 days. A double edged sword really. Best of luck.
I'm not quite sure what the Florida laws are, but if you lived in Oregon, under the Implied Consent Law, since you refused to take the test, you just forfeited your driving privileges for a year and earned yourself a $500 fine. If you admitted you were guilty, or failed the test, the fine would've been less, but the one-year suspension would remain. Talk to a local law office and see what your options are. Since they did not take the test, they could not prove you were drunk, so you could get off scot free, if you're lucky.
you did the right thing. never self implicate yourself. regardless of what the officer requests, always tell him you will not do or say anything without your lawyer. also tell the officer you want to leave, even by leaving your car. he will not let you go so at this point you are assumed to be under arrest. after you have been detained and you request a lawyer, they can not continue to question you without legal assistance. in all likelihood, a good lawyer will then be able to have your arrest thrown out, because you should never be required to help convict yourself. call the local bar association and request they refer you to an attorney that specializes in this field.
As far as driving and drinking. you will get 100 times less than you should! You should just thank god for a wake up call and put any more people in danger like MY FAMILY! Take it like a man or woman.
