i got arrested for dui today and i was not drunk. the officer asked me if i was drinking and i had 2 beers at lunch so i told him that. i got arrested 2 hours later. they made me use the breath machine and it did not register. i dont understand how they could arrest me because there is no way 2 beers 2 hours before could make me drunk and i told them that. The seargant said i was not going to be charged, but I had to pay to get my car out of impound. Do I need a lawyer? Should I have to pay for the impound? Will this go on my record? I have never even had a ticket.
i dont understand... i could have said i had 0 beers but that would have been lying. i think saying i had 2 beers was why i got arrested. i told them the time frame though.

If the officer’s actions were reasonable, you have no recourse. If your driving was erratic, or if you did poorly on field sobriety, his actions would be reasonable.

If you were over the limit it is a DUI. If you are under 21 there is no limit, it is a DUI. If the results are faulty talk to a lawyer.

My uncle used to have alcohol in his Colon. Technically he was over all the time. He carried a card for the local sherrff to see

Sounds like the officer had reasonable suspicion you were driving drunk. We don’t know what the officer’s driving observations were of you. You admitted to drinking two beers and you were driving. Also realize, most people lie when asked how much they have had to drink. If the Sergeant said you were not going to be charged, then obviously it will not go on your record.

Better consult with a lawyer you have to much at stake here not to.
