


DUI Arrest: Do you need to request a DMV hearing if your BAC test results were below .08 in California?
I was arrested recently for suspicion of a DUI - and charged with California VC 23152 A. I didn't commit any traffic violations, the cop pulled me over on the freeway because he claims I weaved in my lane. I don't believe I was impaired or driving under the influence. I was arrested recently for suspicion of a DUI - and charged with California VC 23152 A. I didn't commit any traffic violations, the cop pulled me over on the freeway because he claims I weaved in my lane. I don't believe I was impaired or driving under the influence. My breathalyzer test results showed a BAC of .07 so technically I was under the legal limit. I spent the night in jail but did not have to hand over my license to the officer and was able to get my car back the next day. I think that when I finally go to court they will reduce this to a lesser charge since I didn't get in an accident and have no prior offenses.
If I was charged with a 23152 B, I know the DMV would automatically suspend my license but I wasn't charged with that. That being said, do I need to request a hearing from the DMV?

If you weren’t charged with that, then I would imagine there is no need to worry. You weren’t at or over the legal limit, so they can’t take your license away.
