a friend got arrested on a dui. she opted for the blood test. it came back with a BAC of .27. 3 weeks later before even going to court or being convicted, her lawyer told her they failed to put in a preservative in the vial before adding the blood and therefore the alcohol has duplicated itself an...
a friend got arrested on a dui. she opted for the blood test. it came back with a BAC of .27.
3 weeks later before even going to court or being convicted, her lawyer told her they failed to put in a preservative in the vial before adding the blood and therefore the alcohol has duplicated itself and it now shows a .31 BAC so he is trying to get the charges dropped.
what happens in a case like this? can it be determined how fast the alcohol duplicates itself in a period of time so that they can actually tell what the BAC would have been before it started to duplicate?
hopefully i am asking the right thing i heard this from her while she was drunk so it didn't make allot of sense (you can skip the comments on what a drunk she is-we all know it already). she says her dui will be dropped. i say BS and hope it isn't. she needs to learn. and i can pretty much guarantee it was at least a .27
YES, the lab can determine how fast it would duplicate but it will not be necessary because the lab failed to do the procedure properly and it will not be admissible in court,the judge will dismiss the charges and your friend may or may not learn a lesson but a DUI can mess up your life for the rest of it.~
